Regular Council Meeting <br />6-17-02 <br />Page 20 <br />Dr. Parker said so it's for personal use. <br />Mr. Miozzi said yes and my "Tonka toy." <br />Dr. Parker questioned if the "Tonka toy" going in it? <br />Mr. Miozzi said probably because I don't like it out with all the dust that is created right now. <br />Mr. Marrie addressed Mr. Miozzi and said you commented that your neighbor has one [detached <br />garage] identical to what you want to build-in this 1,200 square foot range. <br />Mr. Miozzi said yes, sir. Mine would actually be further back on my property than his. Split the <br />distance between his yard and the rear property line. <br />Mr. Marquardt addressed Mr. Samac and asked, were there any objections from neighbors and <br />what were the major objections by the Board of Appeals. <br />Mr. Samac replied, at our Board of Appeals' meeting we did have an objection from one of the <br />neighbors. When he left the meeting, I'm not quite sure whether he really then objected or not; <br />he was under the misconception that the garage was going to be at the next-door-neighbor to the <br />north's house (which is Mr. Miozzi's brother.) Once that was clarified, I really don't believe that <br />he had much of an objection. For the benefit of those who may not be real familiar with it, the <br />other garage that he's talking about that is 1,200 square feet in area is pretty much the one that is <br />on that northeast corner of Metro Park and S.O.M. Center Road. There is a vacant lot and then <br />just grass. The detached garage that is behind that house is a 400 square foot detached garage. It <br />has been there for many years. It belonged to a gentleman who was in the repairbusiness at one <br />time (Mr. Strater.) <br />Mr. Marquardt questioned what were the basic objections of the Board of Appeals to granting the <br />variance. <br />Mr. Samac said the basic objections of the Board-again they felt that they don't or shouldn't <br />have the ability to grant variances contrary to the code for virtually any reason. <br />Council President Buckholtz asked how that other one got built. <br />Mr. Samac, Mrs. Mills and others said that was before their time. <br />Mr. Samac guesses it has probably been there for 30 yeais. <br />Council President Buckholtz said we are basically talking about the length and width, the square <br />footage of the structure. In your estimation though, we are talking about a large property. I am <br />not hearing any overwhelming problems from neighbors-we went through that in my first year <br />here-someone wanted to put up a garage behind a Councilman that was very obtrusive. You <br />are talking about in relation to the size of a lot, it is really not that abnormal. <br />20
