Regular Council Meeting
8-19-02
Page 5
.?
? Roll Call: AYES: All
NAYS: None Motion Carried
Agenda Amended
• Award of Bid for road salt - Morton Salt -$27.02 delivered and dumped
Mr. Marrie, seconded by Mr. Marquardt, made a motion to suspend the rules of Council requiring an
ordinance to be read on three separate occasions.
Roll Call: AYES: All
NAYS: None Motion Carried
Rules Suspended
Mr. Marquardt, seconded by Mr. Marrie, made a motion to award Morton Salt the bid for road salt
(at a cost of $27.02 delivered and dumped.)
Roll Call: AYES: All
NAYS: None Motion Carried
Expenditure Authorized
? • Consideration of BOA Case No. 2002-6 (James A. Mills, 6689 Glenview Road;
proposed garage)
Council President Buckholtz stated we can either affirm BOA's decision to reject so a"yes" vote
is to affirm BOA's rejection of the variance.
Mr. Marrie said I thought he was going to do a drawing and present it to Bernie and Doug.
Dr. Parker said I think that comes under discussion.
Council President Buckholtz said we can vote to modify. We have 3 choices: A"yes" vote
would be in support of Board of Appeals' decision to reject the appeal for the zoning changes
(the variance); a"no" vote would be to reject Board of Appeals' rejection of the variance (in
other words we would affirm the project). Council President Buckholtz said in fairness to
everyone involved in this, the recommendation from the Law Deparhnent is to table this item
and revisit with Board of Appeals with a new placement (if you are going to move it back and
reduce the size, trim a little bit off the back) and take it back to BOA. They're meeting
Wednesday night.
Mr. Samac said I don't believe we have enough time to do a notice to area residents for their
reconsideration. I don't know if it's required, or would be required, but under the circumstances
I think it would be wise.
