Regular Council Meeting <br />5-19-03 <br />Page 11 <br />Mr. Marrie asked if he could make a comment before we start on this. (Council President Buckholtz <br />said sure.) Mr. Marrie said after our meeting (our Council Caucus), I personally went down and <br />looked at some of those properties there and there are some problems and concerns without any <br />doubt. I am not an engineer or an architect so I don't have all the answers for it but I feel this <br />administration will do what is right for the residents. I cannot certainly speak for Skoda, Minotti, but <br />I also feel that they will also do what is right. I think when we do this we have to do what is right for <br />both parties. But we do have some residents who are concerned. As I said, I just want to go on <br />record that I feel not that we should, I think we will do what is right for these people. Also, it is a <br />two-way street. I think they both have to live with this but there are some things that have to be <br />done. <br />Mr. Riter said I would like to echo Mr. Marrie's comments. I, too, went this past Saturday morning <br />and spent about an hour and a half on a113 properties and saw a lot of things that did concern me. I <br />spoke with the Mayor and he is very concerned and has been very committed for a long time to <br />make sure that everything that is done is done correctly; not just in the best interest of one party or <br />the other-but in the best interest of all parties involved. Mr. Thomas was walking the ball <br />diamonds and setting up for a picnic when we were there and we were able to address a lot of issues <br />having to do with the Phillips' property. For example, while Skoda, Minotti was nice enough to <br />allow us (and us being whoever is using the ball diamonds) to park on their facility, what happened <br />is anybody that would use that park, that parking, and would go to use the ball diamonds, we would <br />be fiuineling them onto private property through the Phillips' property to get to the ball diamonds. <br />You could see instances where people had maybe walked up through the Phillips' back yard up a <br />ways, realized there was no gate to go in and went through the fence, maybe breaking sections, balls <br />were landing in her yard hitting the house. We picked up a ball while we were there so some netting <br />may be appropriate. Standing in the utility room of Jim and Eileen's house, you can-we've talked <br />about the culvert that was covered-you literally see the culvert here-from their utility room, it <br />kind of pancakes down to there-to one portion of their yard then pancakes down again and again to <br />a very low point. And I know that we heard some comments last week that well the water goes this <br />way, away from their house but there is no way that some of their water doesn't go this way and this <br />way, and right down and puddles in their back yard and actually comes into their house. So, I think <br />however the votes go on these variances we all have to be very, very committed to not only be sure <br />that if these pass that Skoda ends up with a very good building, but also so the residents end up with <br />a very good environment and a very good residential environment. Tom put it very eloquently-it <br />has to be a win-win for both parties. <br />Mr. Marquardt said I have voiced this opinion in the past and I believe that the residents have a <br />perfect right for the Village to uphold our codes and ordinances as we have taken our oaths of office, <br />I believe that if these variances were agreeable to the residents, they would have removed their <br />appeal. If we are going to do this, any kind of the variances should be with the agreement of all <br />parties, the residents and Skoda, Minotti, so I'd have to believe that we are putting the cart before the <br />horse if these residents are not satisfied with what is going to be done to the point that they agree that <br />the variances are fair to them. <br />Council President Buckholtz thanked Mr. Marquardt for his comments and asked if there were any <br />further comments. There were none so Council President Buckholtz continued, I will just echo what
