Minutes of the Regular Meeting of Council <br />Monday, February 19, 2018 <br />Page 15 <br /> <br />NEWBUSINESS ' <br />Motion to approve Planning and Zoning Commission's recommendation at their <br />meeting on February 5, 2018 for final site, landscape and lighting plan approval for <br />ARTIS Senior I.iving East Commons 285 NCB, subject to conditions. (Building <br />Department) <br /> <br /> <br />Mrs. Mills, seconded by Mr. Marquardt, made a motion to approve Planning and Zoning <br />Commission's recommendation at their meeting on February 5, 2018 for fmal site, landscape and <br />lighting plan approval for ARTTS Senior Living East Commons 285 NCB, subject to conditions. <br />(Building Department) <br />Council President Saponaro asked, discussion? <br />There was none. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Recommendation of Planning and <br />Zoning Commission Approved <br />Motion to approve Planning and Zoning Commission's recommendation at their <br />meeting on February 5, 2018 for lot split and consolidation plat approval for 6492 <br />Highland Road - Skoda Construction, Inc. (PP #831-10-007 & PP #831-12-003) <br />(Building Department) Mrs. Mills, seconded by Mr. Marquardt, made a motion to approve Planning and Zoning <br />Commission's recommendation at their meeting on February 5, 2018 for lot split and <br />consolidation plat approval for 6492 Highland Road - Skoda Construction, Inc. (PP #831-10- <br />007 & PP #831-12-003) (Building Department) <br />Council President Saponaro asked, discussion? <br />Mrs. Mills asked, if we vote against this, would he be able to still build on that parcel? I know <br />he has to go before the voters. <br />Council President Saponaro replied, that is something he has already said he is planning on <br />doing. If Planning and Zoning gives a recommendation, we as Council have to have a reason <br />behind why we would not approve it. So we would have to look at their decision and go through <br />that. <br />Mr. Marquardt stated, you would have to justify why you do not approve the recommendation. <br />Council president Saponaro asked, Mr. Budzik, as our Law Director, can we just make an <br />arbitrary capricious decision on why we do not want to follow the Plaiuiing and Zoning <br />Commission's recommendation?
