Collective Bargaining Agreement between <br />Mayfield Village and the I.A. F. F. Local 2619 <br />in excess of regularly scheduled hours as set forth in Section 19.1 in any work period. Vacation, <br />to holidays and optional holidays used during any portion of the work week shall be counted for the <br />purpose of determining the existence of overtime worked during that period. Sick leave, <br />bereavement leave and time paid for any union business per Section 15 of this contract will not be <br />counted as hours worked toward the calculation of overtime. For the purpose of calculating <br />overtime in a week that sick hours are used, only the excess hours worked for that week shall be <br />calculated by dividing the base rate plus longevity by two thousand, six hundred (2,600) hours and <br />multiplying by one. <br />A <br />Section 20.2. Any time an employee is representing the Village in a legal matter as a court <br />witness or in a deposition, he or she shall be compensated at the employee's regular rate of time if <br />such court appearance is during the employee's regularly scheduled tour of duty. If the employee is <br />required to represent the Village at a time other than his or her regular tour of duty and the <br />employee and the Village are not able to reschedule the employee's appearance during his regularly <br />scheduled tour of duty, then the Village will compensate the employee at his or her appropriate rate <br />of pay for such time. All compensation paid, by the court, to the employee shall be turned over to <br />the Finance Department. <br />Section 20.3. All full-time employees, shall, at their election, be able to accrue compensatory <br />time at one and one-half (1-1/2) times the number of overtime hours worked in lieu of cash <br />payment at the same rate that overtime would have been calculated (time and one-half vs. <br />straight overtime), up to a maximum of one hundred forty-four (144) hours. In the event an <br />employee works overtime when his or her "compensatory time bank" is at one hundred forty- <br />four (144) hours, he or she shall be paid cash for such overtime. Employees will be required to <br />cash out all accrued hours of compensatory time in excess of ninety-six (96) hours at the end of <br />each calendar year with the option to cash out all accrued hours. Any compensatory time <br />remaining will be cashed out upon the employee's separation from employment. <br />Section 20.4. Prior to the use of any compensatory time, employees must obtain authorization <br />from the Fire Chief or acting officer in charge. All requests to use compensatory time must be <br />made at least twenty-four (24) hours in advance. When a request for compensatory time is <br />received by the Department, the Chief or officer in charge will review the schedule and, if there <br />is a sufficient number of employees that can be scheduled to work on that date without requiring <br />overtime, the request will be granted. All requests to use compensatory time will be granted on a <br />first-come, first-served basis. <br />ARTICLE 21 <br />SALARY SCHEDULE <br />Section 21.1.
