Minutes of the Regular Meeting of Council
Monday, July 15, 2024
Page 11
day notice for a termination. We were hoping to get to 90 days, but the way the notices got out
we wanted to have it end at the end of the month as opposed to trickling over into a partial month
and then you get into partial rent payments and things like that so it ended up being an 82-day
notice. The three properties are on Wilson Mills. They are no longer needed for any municipal
purposes. The notices were sent out. The intent is to have those properties listed for sale on the
market, whether it be MLS, or however you want to define that. This is the first step in that
process.
Mr. Arndt asked, why was it decided in the last week or so? Where did the September date come
from?
Ms. Calta replied, there were discussions about providing the tenants notice because the decision
was to move forward with the sale of these properties. The first step in that process was to notify
the tenants. We looked at those leases to see what sort of notification we are required under the
law to provide. We felt that a 90-day notice would be more appropriate than a 30-day notice.
Mr. Arndt stated, I know they asked a lot of questions. Is there any feedback?
Ms. Calta replied, the one thing I can say about the Executive Session is that all of Council present
that night was in the Executive Session. There may be a misinterpretation when reading those
minutes. When we convene into an Executive Session all of Council is included in that Executive
Session. There may be other individuals that are also included. The minutes reflect those
additional individuals, whether it be the Director of Administration, the Law Director, etc. but all
of Council is always included. The only exception I can see is if a Council member was not present
that night they would not have been in the Executive Session. Hopefully that makes a little bit
more sense.
Ms. Finnie stated, according to the Minutes, other Council were present that evening and were not
invited into that Executive Session.
Ms. Calta replied, Council members are not invited into an Executive Session. They convene into
an Executive Session.
Ms. Finnie quoted, "Council will be going into Executive Session and I would like to invite the
following individuals into Executive Session. Ms. Calta-
Ms. Calta replied, that's me.
Ms. Finnie stated, Ms. Rich.
Ms. Calta replied, that is the Finance Director.
Ms. Finnie stated, Ms. Wolgamuth.
Ms. Calta replied, that is the Director of Administration.
