Building will be used for executive type offices with <br />no retail use or doctors` offices planned. There will be no pole or <br />ground sign, only the address will be on the building. Lighting will <br />remain the same. R. Bierman movedto submit the proposal to convert <br />the former racquetball club to office building at 29168 Lorain Road <br />to the Architeetural Review Board, to the Safety and Engineering De- <br />partments, seconded by T. Morgan,and unanimously approved. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />No items. <br />V. COMMiTNICATIONS : <br />Chairman Burns. announced that members of the Timber Trails Homeowners had <br />requested t'o, address the Gommission. Mr. Godfray, Vice President of the <br />association, expressed their concerns because Night Fa21 Restaurant was <br />operating and has not been approved by Planning Commission; they are ques- <br />tioning why Frauleins needed approval and Night Fall did not. Assistant <br />Law Director Dubelko explained that Frauleins was making an extensive <br />additi.on to the parking area plus exterior alterations to the building, <br />and if Night Fall is only doing interior alterations, has not increased <br />their seating, and withdrew their request for a curli cut they do not need <br />approval. Mr. Godfray advised that eustomers are parking on the gravel <br />area, not only on the hard surface parking Tote Building Commissioner <br />Spino stated that, the Buildi:ng Department is researehing the propertv to. <br />ascertain-what original approvals were given and.when. Mr. Maximuk, Presi- ' <br />dent of the Association, questioned'_if the_ Building Department did not <br />have to cfieck the seating capacity and parking requirements prior to the <br />opening of the business. Building.Commissioner.Spino stated that Night <br />Fa1T was never cTosed. Mr. Maximuk claimed that it was closed, f'or at least <br />nine montfis ; and' also, tfiat no permits were taken out. until fie notifie(il <br />the Building Department that work was being done. Mr. Spino stated that <br />only the b ar was being remodeled. He also advised that the owner was to <br />submit a document showing approval for a seating capaeity of 300 people, <br />whicfi he claims has been reduced, and a seating plan 6ut these have not <br />been received as yet. In response to complaints about the light on the <br />rear of the b uilding, Mr. Spino advised that the light had been reposi- <br />tioned and that if it is still a problem this should be taken up with the <br />Building Department.
