Cook Assembly Plat <br />The proposal is to combine permanent parcels 232-28-14 and 232-28-15 <br />into one lot. The parcels are located on the westerly side of Silverdale <br />Road. The property is zoned "B" Residential and the assembled parcel <br />conforms with the minimum frontage and lot size requirements. <br />Mr. Waterb ury represented the owner. City Engineer Schaller explained <br />that the two non-conforming lots will be assemb led to make one con- <br />forming 1ot. R. Bierman moved to approve the Mark A. Cook Assembly <br />Plat combining parcels 232-28-14 and 232-28-15 into one lot on Silverdale, <br />the west side of the street, seconded by E. Traczyk, and unanimously <br />approved. <br />A short recess was called at this time. <br />2) Deerpath Subdivision No. 6. <br />The project is located north of I-480 on the west side of Clague Road. <br />The land is zoned "C" Residential. Tao alternate layouts are being <br />presented. <br />Alternate 1- Proposes a connection of Elm Road to Clague Road and <br />would create 24 sublots. <br />Nonconforming features <br />1) A fifty foot wide right-of-way (State of Ohio property) is <br />proposed to be used for the connector to Clague Road <br />(Section 1101.02 (d) 12A.) <br />2) Turnout radii of 30 are not provided at the intersections <br />of the right-of-way. (Section 1101.02 (d) 12C) <br />Alternate 2- Proposes a cul-de-sac at the northerly end of Elm Road <br />and would create 23 sublots. <br />Nonconforming features . <br />1) The length of the proposed cul-de-sac exceeds the 500' <br />maximum. (Section 1101.02 (d) 12E.) <br />2) A block of land north east of the cul-de-sac would be created <br />and is non-buildable. (Section 1101.02 (d) 12B.) <br />3) Sub lot 23 does not conform to the minimum lot depth require- <br />ment of 135 feeto (Section 1157.01 C.) <br />Mr. Giesser, attorney for the owner, Mr. Clingman, explained that when <br />the State took property for I-480, they also took a portion of the Elm <br />Road right-of-way (a paper street), at that time they negotiated with <br />the City to replace it with a 50' right-of-way (60' is required b_y code) <br />connecting the existing Elm Road with Clague Road. Mr. Giesser read <br />a letter from the State of Ohio, dated February 11, 1987 which was <br />addressed to Mayor Petrigac which explained what happened at the time <br />I-480 was being planned. In conclusion they stated "....The State has, <br />on several occasions, requested the City of North Olmsted to pass a <br />resolution accepting the conveyance of relocated Elm Road right-of-way. <br />If the City does not intend to dedicate this land for public road <br />purposes we would appreciate being advised of this so the land can be
