He presented a step plan of the proposal, explaining that the <br />building configuration could change, the north side of the property will <br />abut the existing residential area, there will be 160 units with a <br />commons area in the front for meals, activities, etc.; land use will <br />fa11 under the Multi-Family zoning classification; there will be ap- <br />proximately 15 units per acre with a half parking space per unit; a <br />drive will surround thei r property with ingress and egress only on <br />Columbia Road. Mr. Justice responded to questions from members of the <br />audience who did not identify themselves: the three properties omitted <br />from this request are fronting Columbia Road; Cardinal Industries have <br />not been informed of the planned use of the adjacent vacant parcel (facing <br />Brookpark Road), they might object to some retail developments to their <br />facility, however some would be compatible; these units are all rentals, <br />most of them are considered independent living facilities, with approxi- <br />matley 30 units being catered or assisted living; there is no nursing <br />home care available; the building will be approximately 50 feet from <br />the rear property lines of the adjacent residential property and a two <br />lane road would abut this line, no fencing is planned abutting the <br />residential property, however they are planning to landscape and would <br />consider a fence if the neighbors want it. Mr. Morgan questioned why the <br />adjacent property fronting Brookpark Road which is already zoned Multi- <br />Family was not considered for this proposal. Mr. Justice responded <br />that-th-ey had -inquired -about -that- parcel,--but were-advised by the owners, <br />Biskind Development=°Company,-that it was-not for-sale,-they have not <br />been- told what the -owners- are-_planning for th-at- prop:erty, = and--they,---too,- <br />are interested in the specific plans. He further explained th at the <br />Biskind Development Company now holds a lease from the present owners <br />of the property for which Cardinal is requesting rezoning, and Cardinal <br />in turn holds a lease_from Biskind Development. NeighbDrs have several _ <br />concerns: if this propezty is rezoned, then Cardinal's development would <br />create a buffer zone for the remaining property facing Brookpark Road <br />which could then be rezoned for a commercial use; that after this pro- <br />perty is rezoned Biskind Development could exercise their option and <br />develop the property themselves. Neighbors reiterated that they did not <br />want any commercial development on Brookpark, they basically have no <br />problem with Cardinal's proposal, but would prefer that this property <br />be used as zoned for Single Family, and that Cardinal develop the pro- <br />perty already zoned Multi-Family, pointing out that a strip shopping <br />center would not be desireab le behind a senior citizens complex. Mr. Morgan <br />pointed out that once this -property is rezoned it can be used for any <br />use that is permitted in that zoning classification. Mr. Justice stated <br />that there could be issues, other than rezoning, that could interfere.w'ith <br />their picking up the option, however, once the property is rezoned, it <br />is their honest intention to build a retirement village, and he also ad- <br />vised that the lease they hold from Biskind is legally binding. Residents <br />also belieue th at if this property is rezoned Multi-Family, and this pro- <br />posal does not go through, it would be easier to rezoned both parcels to <br />General Retail.
