? <br />PLANNING COMMISSION JULY 28, 1987 PAGE 7 <br />and continue beyond the railway easement both parcels would be non- <br />conforming in width (200 feet required) and sublot l.presently contains <br />a residence which is b uilt over the property line. Mr. Schaller further <br />pointed out that the Limited Industrial buffer zone also ma_y impact sub- <br />lot 1. Mr. Kanareff, the developer, explained that he, with others, own <br />some adjacent property, and are att.empting to acquire more property <br />between Timber Trails subdivision and an old unrecorded subdivision with <br />the intention of later assembling parcels for.future development, and <br />also advised that he held half interest in the 30 foot right of way (the <br />interurhan easement) that runs from Timber Trails to the county line and <br />bisects the Zahurancik property (parcel 2). Since the Zoning Code does not address this type of aquisition of property to be held for <br />future assemlily, he is requesting guidance from the Commission; pointing <br />out that there is no intent to develop the property in its present <br />configuration; and that, with the_acquisition of this.property, he <br />and Mr, yarga; an adjacent property'owner, would own a total of 26 acres <br />which will be held for future development. The Commission would like <br />to assemble the two parcels which contain the Zuhurancik home in order <br />to make those parcels more conforminge Assistant Law Director Dubelko <br />advised that this proposal would have to be referred to the Board of <br />Zoning Appeals for variances for no frontage and for width of less than <br />200 feet and the Commission could recommend.that the variances be granted <br />with the condition that parcel 1 be assembled to the adjacent parcel, <br />but no variance w.ould be required for this property even though it would <br />not be conforming to the Limited Industry District requireMents because <br />the assembly would make 2 non-conforming lots less non-conforming, but <br />a variance must be granted to split off parcel 2 which has no frontage <br />and is less than the required width. He believes that- the.Board of <br />Zoning Appeals should place a condition on the variance that parcel 2 <br />will be. assembled prior to being developed. Mr. Kanareff stated that it <br />has not been decided.if the property will.be developed as industrial or <br />if they would request a rezoning to develop as residential. B. Gorris <br />moved to refer the division of permanent parcel 234-03-06 into sublots <br />1 and 2(also known a,s the Margaret Zahurancik lot split) to the Board <br />of Zoning Appeals with the recommendation that they approve this con- <br />tingent upon parcel 2 being assembled to parcel,3_ 03=13 and parcel 1 <br />being assembled to 234--03-07 in effect making 2 non=conforiuing-7.ots-'? <br />non-c riforming,__t_ose varian_ce being requested are-for_frontage <br />r------ <br />and square footage for sub lot 1 and frontage and square footage for sublot <br />2, seconded by J. Burns; and unanimously approved. Mr. Schaller stated <br />he did not show s.quare footage for sublot 2 and is not sure it:d"o.es npt have <br />required.area, but this can be determined prior to going to the Board <br />of Zoning Appeals. <br />V. COMMUNICATIONS: <br />Irlemo from Mayor Petrigac advising that a Building Commissioner has'been <br />hired and will be attending all Planning Commissibn meetings, and further <br />stating that she had been unaware that there had been no representatiee <br />from the Building.Department present at meetings. <br />A copy of a letter to the Mayor from Colebrook Condominium Association <br />advising that the residents; of Jefferson Place,.
