" <br />6) Columbia Village Apartments, Phase III, located to rear of lots.on the <br />north side of Lorain Road between Columbia and Root Roads. <br />Proposal to construct avartments. <br />R. Mongello, architect; his associate, S. Schill; and Mr. Skenzik, repre- <br />senting Realtek Industries, presented nlans for the final phase of <br />Columbia Village Apartments explaining that the site nlan has been <br />revised for the nreviouslv approved Phase III; thev.will now be con- <br />structing three story apartment building with elevators, instead of <br />the originally anproved two story townhouses. Mr. Mongello stated that <br />the_ underground imnrovements and foundations have been constructed and <br />will have to be removed. In 1985 thev had received a ruling that with a <br />combination of garden anartments and mid-rise anartments, they would be <br />permitted to construct 25 units per acre.in the Mixed Use District,' <br />however, thev are only proposing to constxuct 54 units. He.also advised <br />that these units may be sold as condominiums. Building Commissioner <br />Conwav advised that in the Mixed Use District the. code requires fifty <br />foot buffers adjacent to residentially zoned nroperty and this nronertv <br />abuts the John Knox Presbyterian Church pronerty, the rear portion of ' <br />which is zoned as Single Family, Residential. He also nointed out that <br />the code does not address three story multi-family structures in this <br />district, it does permit 5 stor_y high rise or 22 story multi-family <br />structures. He believes that both of these issues must be addressed bv <br />the Board of Zoning Appeals. Mr. Mongello questioned how Phase I was . <br />approved, since it is not 50 feet from residentiall_y zoned property and <br />advised that thev would determine where the zone line is located on <br />the adjacent pronerty. It was decided that the Law Department will <br />research the code Testrictions; and if it is so determined, the proposal <br />will be submitted to the Board of Zoning Appealse Mr. and Mrs. Herman, <br />ad.jacent nronerty owners, viewed the plans and voiced no objections. <br />The Commission questioned wh_y th.e association of. the condominium.located <br />on the same property was not notified. Mr. Skenzik stated that he is the <br />Vice President of the Association which will be turned over to the owners <br />in a few weeks. A notice will be sent to him, and he will, in turn, <br />notify the residents. J. Burns moved to continue the Columbia Village <br />Apartments, Phase III, proposal until such time as the question of set <br />backs and permitted use of a three story building in the Mixed Use District, <br />and if necessary, the Board of Zoning Appeals, seconded by R.
