<br />Request for variance (.1123.12). Request 44 f.oot rear y ard variance for natio
<br />enclosure. Violation of Ord. 87-93, Section 1135.08. Also request special
<br />permit to add to non-conforming,dwelling. Special permit required Ord. 87-93,
<br />Section 1165.02.
<br />Chairman Remmel.called all interested varties before.the Board. The oath was
<br />administered to Mr. and.Mrs. Filka, and Mr. Morrison,.contractor. Mr. Gomersall
<br />stated that he has a nrobleTn with the request since the enclosure will only be
<br />6 feet from the pronerty line and he believes there is too much house on the
<br />lot now... Mr. Stevenson, neighbor to the rear who is most effected by the
<br />structure, :ia_as administered the oath and stated that he had no objection at
<br />all to the request. R. Bugala-moved to grant the request 44 foot rear yard
<br />variance for apatio enclosure for Mr. and Mrs. Larry Filka, 6649 Gbnress Dr.,
<br />seconded by B, Grace. Roll call on motion: Bugala, Gomersall, and Remmel,
<br />no. Mr. Grace,.yes. Motion failed to pass. Variance denied. Mr, and Mrs.
<br />Filka discussed request with the Board. Mr. Remmel suggested that p.erhans a
<br />privacv screen would heln, Mrs. Filka stated that she had cancer and would
<br />like to be able to sit on the patio.and pointed out that other homes in the
<br />area had patio.enclosures close to the property line_. It was suggested that
<br />they re-work the plans; and perhaps put the patio on the garage side of the
<br />house; They.wiil dfiscuss this with the Building.Commissioner.
<br />10. Columbia.Village Anartment.s, Phase III, (Realtek Industries), located to rear
<br />of lots on the north side of Lorain Road between Columbia and Root-Roads.
<br />Request for variance (1123.12). Request variance to construct 3 story apart-
<br />ment building. Violation of Ord. 87-93, Section 1149.02 c& d. Also req_uest
<br />variance to have less than the 50 foot buffer adjacent to residential vropert_y
<br />(10 feet at closest.point). Violation o.f Ord. 87-93, Section 1149.05 d.

<br />administered to N[r. Mongello, architect; his associate, Mr. Schill; Mr. Skenzik,
<br />representing Realtek Industries; adjacent neighbors,?Mr: and Mrs. Herman; Pastor
<br />Jenkins, Columbia Road Baptist Church; and members of the Hyde Park Condominium
<br />Assocaition which is located on the same property: D. Rosenthal, A. Boguski,
<br />Mr. and Mrs. Garlock; G. Humpka, Mrs. Lawson, Mr. and P4rs. Borelli, Mr. and Mrs.
<br />Borrelli, Mr, and Mrs, Hrezik, B. Hreczik, S. Hrczik, J. Geist, A. Lappin, and
<br />Mr. and Mrs. Okin. Mrs. Borrelli and Mr. Rosenthal-9 officers in the condominium
<br />associ:ation, explained that the notice sent to the association.in care of
<br />Mr. Skenzilc, who is also an officer, was posted on Monday afternoon, and there
<br />was not sufficient time to notifv all residents, especially those who are
<br />absentee owners. The members were totally unaware that this proposal was
<br />being pres.ented to the city, explaining that when they.bougtit their condominiums
<br />they were told of the previous?. plans for townhouse condominiums (for which
<br />the foundati-ons are already constructed). They believe the develoners have
<br />mis-represented what they are intending to do to the owners. Mrs. Borrelli
<br />stated that they are not necessarily opposed to.pronosal, but would like the
<br />provosal exulained fu11y. Law Director Gareau stated that when the original
<br />proposal was.presented to the city, a variance was granted for the 50 foot buffer
<br />and this variance might include this phase of the development.. He suggested
<br />that this should be researched. Building Commissioner Conway advised that the
<br />concept of the plan has been altered from what was originally approved.
<br />Mr. Mongello explained that the Zoning Code.does not address three story multi-
<br />family buildings in this zoning classification, but they would be permitted
