Mr. Yesberger, owner of North <br />Olmsted Golf Gourse, stated that letter was from both golf courses. Mr. Brennan <br />explained that the above requested variances are.sacrewhat different from the <br />request of Pheasants Walk since Sunrise developed the land and the houses are <br />being built by different builders. At the time they develoned the lots they <br />did not know what type of homes were to be built, however, the lots conform <br />to the codes. Since some of the builders may need variances, they are re- <br />questing these variances in order to keep individual building from coming in <br />with each request. Councilman Tallon stated that during the discussion on <br />the platting of the lan.d it was made clear that the lots were must conform <br />to ttie type of housing to be built. He cannot understand why they are now <br />requesting variances on 80% of the lots. Mr. Grace stated that he had inquired <br />about developing some of these lots and he was told to submit building plans <br />that would conform to the size of the lots. Mr. Brennan stated that the cost <br />of'developing the property was such that larger homes would have to be built <br />in order for the b uilders to make a profit.. Chairman Remmel believes..that <br />the Board should control any variances individually. Mr. Graces stated there <br />is an ethical question as to whether the City should grant variance when the <br />subdivision plat was presented and approved with the expectation that the . <br />houses would conform. Mr: Yesberger stated that many of these variances <br />would bring the houses even closer to the fairways, pointing out that he and <br />Mr. Schepp had worked with the developer in order resolve problems with the <br />homes abutting the golf courses. C. Remmel moved to grant the 10 foot front <br />set b ack variance for sublots 1-6, 10-21, and 30-59 and the 10 foot.rear set <br />back variance for sublots 2-3, 5-6, 10-22, and 33-59, as requested by Pebblebrook <br />Subdivision, seconded bv B. Grace. Roll call on motion: Remmel, Grace, <br />Bugala, and Gommersall, no. Motion failed to pass. Variances denied. Mr. <br />Gareau stated that the first requirement-for granting any variance should be <br />hardship as it concerns the size, shape or topography of the land that is <br />not shared by other properties in the immediate area and that economics are <br />not a factor. Mr. Brennan was advised that the builders could come back on <br />an individua•1 basis. <br />8. Robert E. Cornelius, 5340.Evergreen Dr. <br />Request tor variance (1123.12). Request variance for location of tool shed <br />(permit issued for conforming location and shed is installed): Violation of <br />Ord. 87-93, 'Section 1135.02(d)-1. <br />Chairman Remmel called all interested.parties before the Board. The oath was <br />administered to Mr. Cornelius and a neighbor,.Mrs: Brown. Board had no pro- <br />blem with the location variance. R. Gouiersall moved- to grant the request of <br />Mr. Robert Cornelius, 5340 Evergreen Drive for a variance for the location of <br />the tool shed, seconded by R. Bugala, and unanimously approved. Variance <br />granted. <br />9. Richard and Deborah Nelsen, 7009 Warrington Request for variance (1123.12)a Request location variance for tool shed. <br />Violation of Ord. 87-93, Section 1135.02(d)1. Note: existing shed to be removed. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Nelson who.explained that the old shed which is <br />located next to the house will be removed after the new shed is completed. <br />They were advised that there might be deed restrictions.about having sheds in <br />their subdivision. R..Bugala moved to grant the location variance for the <br />tool shed with the stipulation that within 60 days of the completion of the
