The Board agreed that there <br />should be a minimum of 3 feet from the garage and the property line and <br />because additional driveway must be installed they do not believe that <br />moving the garage over would be a problem. C. Remmel moved to grant a <br />2 foot variance on the left side line for Mr. Smalley, 3505 West 231st <br />Street; seconded by J. Helon, and unanimously approved. Variance granted. <br />6. William and Sandra Ball, 24358 LeBern Drive <br />Request for variance (1133.13). Request 5 foot variance for distance between <br />house and proposed detached garage. Violation of Ord. 63-33, Section 1151.04-C. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. and Mrs. Ball. B. Grace moved that a 5 foot variance <br />be approved for distance between house and proposed detached garage, seconded <br />by R. Bugala, and unanimously approved. Variance granted. <br />7. Kalman and Mary Melegh, 28010 Wisteria Dr. <br />Request for variance (1133.13). Request 1 foot height variance for fence. <br />Violation of Ord. 62-33, Section 1151.04-H. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mrs. Melegh who explained that their patio is higher <br />than the adjoining properties and they can see into the neighbor's dog <br />run for which a variance had been granted previously. She stated that the <br />neighbors had previously been breeding dogs, but that is no longer the case, <br />however the dogs are still a problem and they would like the fence rather <br />than continually complaining. Board would like to continue this case so <br />that they can research the variance which was granted to the neighbor pre- <br />viously. B. Grace moved to continue the case until the next meeting, <br />seconded by C, Remmel, and unanimously approved. Case continued. <br />8. Grace Mort, 5359 Decker Road <br />Request special permit to add to non-conforming dwelling (front set back). <br />Special permission required Ord. 62-33, Section 1231.02. Also request 7 inch <br />total side yard variance. Violation of Ord. 62-33, Section 1161.01. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Szabo, contraetor;, Mr. and Mrs. Jernigan, neighbors;, and <br />Mr. and Mrs. Beck, residents. Proposal was explained to ne'ighbors. Mr. Jernigan <br />stated that the addition which is to enlarge her bedroom will.be added to the <br />side of the property adjacent to his living and dining rooms, Mr. and Mrs. Beck <br />are questioning the fact th at this house contains a non-conforming business <br />(the making and selling of craft items) and now, since they are making exterior <br />changes, they should be made to conform to the codes and stop running a <br />business. A variance had been granted to use this property for a real estate <br />office and prior to that was a legally non-conforming tailor shop. Law <br />Director Gareau stated that this type business could possibly be a-permitted <br />home occupation and would like the Building Department to check into this, <br />and further advised that the:.bus.iness was a separate-issue-from this proposal <br />to add to the dwelling. Mr., Jerigan was advised-that the request is only for <br />? a 7 inch variance.. The requested var.iance is on the opposite side of:the <br />. property and the set b ack on his side does conform. B. Grace- moved to approve <br />ttie variance for the 7 inches and the special permission to add to a non- - conforming dwelling, seconded by R.:Bugala, and unanimously approved.
