BOARD OF ZONING APPEALS MAY 6, 1987 PAGE 2 <br />permit. R. Bugala moved to grant the special permit to add to the non- <br />conforming dwelling (front set back) for Raymond Heinert, 5026 Porter Road, <br />seconded by. J. Helon, and unanimously approved. Special permit granted. <br />5. Wayne C. Parker, 5792 Dorothy Dr. <br />Chairman Remmel advised that this case would be delayed until later in <br />the meeting. <br />6. David Holian, Sublot 2, Columbia Road (northeast corner of Columbia Road <br />and Cedar Point Hill). <br />Request for variance (1133,13). Request 2 foot variance for co3[ner lot <br />set back for new house. Violation of Ord. 62-33, Section 1159.02. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Holian, the builder, who presented a drawing of <br />the house that is to be built and explained that the purchaser wanted a_ <br />50 foot house and because of an easement on the other side of the property, <br />they could not znove it to that side. He pointed out that Cedar Point Road <br />had no sidewalks and there is a 30 foot right of way, and the house would <br />be located 23 feet from the right of way. R. Bugala moved to grant a <br />2 foot variance for a corner lot set back for a new house, sublot 2, corner <br />of Columbia Road and Cedar Point Hill for David Holian, seconded by J. Helon, <br />and unanimously approved. Variance granted. <br />7, Gene F. Rech, 5350 Sunset Oval <br />Request for variance (1133.13). Request 1 foot height variance for fence <br />on rear property line. Violation of Ord. 62-33, Section 1151.04-H. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. and Mrs. Rech who explained that there is church <br />property behind their house, but the I-480 ramp is directly behind this <br />property and lights from the cars shine into their home. Part of the <br />property is heavily wooded, but one section is not. They do not believe <br />that a 5 foot fence will help, since the house is higher. The Board had <br />turned down a previous request for a 6 foot fence on relocated 252. They <br />believe that a conform.ing fence would be satisfactory. R. Bugala moved to- <br />grant a.l foot height variance for a fence on rear property line at.5350 <br />Sunset'Oval for Gene F. Rech, seconded by J. Helon. Roll call on motion: <br />Bugala, Helon, and Remmel, No. Motion failed to pass. Variance denied. <br />8. Robert E. Ralph, 4523 Brendan Lane <br />Request for variance (1133.13). Request 4 foot rear yard variance for patio <br />enclosure. Violation of Ord. 62-33, Section 1163.01. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Ralph who presented a letter signed by neighbors <br />Mr. Sikora and Mr.. Bumm stating that they had no objection to.proposal. <br />Board has seen the property and stated it is a minor encroachment. C. <br />Remmel moved to grant.the 4 foot rear yard va'riance for a patio enclosure <br />for Robert Ralph at_ 4523 Brendan Lane, seconded by J. Helon, and unanimously <br />approved.
