<br />_ ?. <br />. ? <br />PLANNING COMMISSION JULY 12, 1988 PAGE 2 <br />2) Nightfall Night Club, 30850 Lorain Road <br />Review of site plan (continued from Planning Commission meeting of <br />January 27, 1987 as ordered by the court). <br />Continued from Planning Commission Meeting of June 28, 1988. <br />Mr, Horvath, owner, and Mr. Braun, attorney, presented parki.ng,lot <br />plan. Assistant Law Director Dubelko explained that this case is <br />presently in court, that the judge had previously determined that the <br />property was in violation of a number of provisions of the Zoning Code <br />and the case is now under appeal. Since there have been continuing <br />complaints about parking violations, motions have again been fi.led. <br />At a hearing approximately one month ago an agreement was reached that <br />the owner would be permitted to pave his parking lot subject to ulti- <br />mately meeting all city code requirements; that the city would expedite <br />approvals in order to meet an August lst deadline; and that a barricade <br />was to be installed to prevent any parking on the gravel area until the <br />lot is completed. He has subsequently advised the court that the owner <br />has not appeared as scheduled on the past two Planning Commission <br />agendas, that the barricades have been ineffective and parking on the <br />gravel has not been discontinued. Building Commissioner Conway advised <br />that no permits have been requested in the past month and that by his <br />last count in September 1987, there were 22 seats in the establishment <br />and that 125 parking spaces are proposed and would conform. He will <br />meet with Mr. Horvath the next day to verify that the seating has not <br />changed. A retention and drainage plan has been submitted to the <br />Engineering Department and will be reviewed. It was verified that the <br />proposed driveway is 60 feet from-the intersection and.will conform to <br />the code and that the curb on the'abandoned drive must be replaced.The Commission has several concerns: driveway enters into parking spaces, <br />not an aisle,and this could be a problem with safety vehicles; plan " <br />does not include dumpster location or screening;no.laading area is shown; <br />no lighting, either new or existing is noted; and no landscaping, other <br />than grass, is shown. Since there have been complaints that cars are <br />being driven over the sidewalk and curb onto Hickory Lane, Mr. Thomas <br />suggested that some type of buffer, either mounding or planters, be <br />installed in the 7 foot green area or perhaps the 8 parking spaces in <br />that area could be eliminated, landbanked, or relocated to the area <br />behind the house (house on same lot); and further that the driveway <br />could be moved east to line up with the aisle. Mr. Horvath claimed <br />that if two trees are replaced on Hickory Lane, no cars could be driven <br />through and that he prefers the drive toward the west since customers <br />frequently drive past the existing drive. It was pointed out that <br />these trees are in the right-of-way and are maintained by the Timber <br />Trails Homeowners Association. Mr. Dubelko advised that at the time <br />the court ordered the fence to be installed, Mr. Horvath was supposed <br />to add 20 feet of landscaping from the fence along Hickory Lane and <br />this was never done. Mr. Horvath maintains that he needs all of the <br />proposed parking, that he prefers not to put additional parking closer <br />to his home, and Mr. Braun suggested that they could put in 4 foot <br />; poles as a barricade. Pictures of the property which were presented <br />? at a previous meeting were again studied and will be forwarded to.the <br />; Architectural Board. Mr. Braun assured the Commission that the owner <br />; would be paving the entire lot, not just the gravel area. Mr. Morgan <br />; summarized for the developer everything that would be needed for the <br />: Architectural Board of Review. T. Morgan moved to forward the site
