Mr. Boyer <br />advised that by their preliminary review of the property it would appear <br />the rear portion of the property is zoned Limited Industry, and also <br />that there are two separate parcels involved which will have to be combined. <br />Assistant Law Director Dubelko advised that the Planning Commission could <br />recommend that this rear portion be rezoned to General Retail. Mr. McCafferty <br />believes that only a small segment of the rear triangle is Limited Industry. <br />Mr. Moroan does not beleive the Commission should look at one parcel for <br />rezoning, they should consider the entire area. The Commission would like <br />to fiave a drawing showing adjacent properties, since it is possible these <br />parcels are being used residentially, and the parking area is quite close <br />to the east property line. A member of the audience stated that he owned <br />the house to the west which is an office building and it was determined <br />that the property to the east is also being used as a business although <br />it is possible that it is also a residence. Mr. Morgan suggested that <br />the three foot buffer on the east side of the property be increased, that <br />the developer consider landbanking the front parking spaces and possibly <br />the loading zone, as well as eliminating one driveway and requested that <br />these changes be submitted to the Architectural Board of Review. Mr. Poth, <br />an adjacent neighbor, was advised that this would be.a one story building <br />and that there would be approximately 100 feet of natural.area to the <br />rear. Mrs. Bizantz, another neighbor, would like a guarantee in writing <br />that the rear buffer would remain natural and is concerned about lighting. <br />Members explained that th'e Commission tries to maintain a natural buffer <br />whenever possible; that the General Retail portion of the lot could be <br />fully developed, but the Commission always requires some type of buffer, <br />fencing, trees, shrubs, etc, but they could not guarantee that the woods <br />would remain indefinitely, and lighting would be discussed. Mr. Boyer <br />advised that if a storm sewer outlet is available they will be required <br />to tie into it, and if not, some type of on site retention would be re- <br />quired. B. Gorris moved to forward the Owen E. McCafferty proposal to <br />construct an office building, west of 30940 Lorain Road to the Architec- <br />tural Board of Review; also to the Safety Department, the forester, and <br />the Engineering Department for their input; and with the understanding <br />that the developer is going to alter this site plan to indicated pro- <br />posed landbanking of certain parking spaces which he now considers to be <br />above and beyond his requirements and to try to better sheild this <br />property in whatever way he deems appropriate from what is still a <br />residential area on the east and incorporating one driveway on the new <br />plan, and with the notation that the developer will maintain a 100 foot <br />natural buffer in the back, seconded by M. Betts, and unanimously <br />approved. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />1) David S. DiBenedetto Assembly Plat <br />The proposal is to combine and assemble into one (1) lot, permanent parcel <br />numbers 232-25-5 and 232-25-6 (sublots 2-A and 3-A of the DiBenedetto <br />Resubdivision, as recorded in Volume 238, Page 64 of CCMR).located on the <br />north side of Brookpark Road Extension. This assembly was stipulated by <br />Planning Commission on 7/26/88 as part of the recommendation for rezoning <br />of these parcels. The proposal conforms to the Zoning Code requirements <br />for frontage and area in a Retail Business, General, District.
