Assistant Law Director Dubelko advised that despite <br />what was allowed by the former Building Commissioner, the developer is_ <br />bound to comply with the Zoning Codes and he would have to request vari- <br />ances from the Board of Zoning Appeals. It was pointed out that they <br />could not landbank spaces since there is no available property, but it <br />would appear that they did not need the additional spaces required, and <br />that frequently the Commission had suggested eliminating one driveway, <br />Mr. Gorris stated the he would like to see the fence and landscaping <br />installed prior to the construction of the buildings. T. Morgan moved <br />to forward the proposal to the BZD Committee with Planning Commission <br />approval and with the condition that the landscaping and fencing be con- <br />structed prior to the construction of the building, and also that the, <br />developer s_eek variances for the 29 parking spaces and the second loading <br />zone to be consistent with our codes and that the Planning Commission <br />would recommend approval of the variances in that they feel the use of <br />the building is lighter and the code requiring the additional parki.ng <br />spaces is not necessary based upon the existing buildings and traffic <br />patterns. At this point, Mr. Bierman pointed out that the rear building <br />was only 20 feet from residentially zoned property (belonging to the <br />school board) and he doubts that a variance would be granted for that. <br />Mr. Gorris stated that if the Board of Zoning Appeals is willing to grant <br />the rear yard variance, then they should be aware that the Commission has <br />no problem with the parking, driveway, and loading zone variances. Mr. <br />Alorgan withdrew his motion. T. Morgan moved to table the Office Park <br />proposal at 28900 Lorain Road in order for the developer to go to the <br />Board of Zoning Appeals to request the 4 variances required: the 30 foot <br />setback variance on the corner of the northwest building, the loading <br />- dock; the parking; and the one drive, and we would like the Board of <br />Zoning Appeals to: be aware of the fact that should they approve the 20 <br />foot set back (30 foot variance) for building number 5, that the Planning <br />Commission would have no problem with the variances being granted for the <br />parking, the loading, and the one driveway, seconded by J. Thomas, and <br />unanimously approved, <br />6) Suburban Auto Body and Frame, Inc., 4860 Dover Center Rd. <br />Proposal to construct an addition. <br />Mr. Papotto, owner, and Mr. Kanareff, builder, presented plans to construct <br />a 336 square foot office addition and to renovate the north and east ele- <br />vations with a dryvit system and a mansard. The south wa11 will be <br />sandbZasted and repainted. Mrl.Kanareff presented a revised site plan <br />showing parking spaces on the Dover Center side of the building. Mr. Conway <br />pointed out that.cars would have to back directly out onto Dover Center <br />Road and that there was no 7 foot landscape buffer as required. Mr. Papotto <br />stated that cars have been backing into Dover Center for the last 27 years; <br />that some of his property was taken when the street was widened: he bought <br />the Mill Road property to conceal the wrecked cars the city objected to; <br />this plan will keep the cars parked on Dover Center Road in a single file <br />(another objection of the city's); he has another location which will cut <br />down on his business here; and finally he is trying to improve the looks <br />of the building. Mr. Morgan suggested making the entrance to the office <br />off Mill Road and putting the customer parking at that location. Commission <br />?-
