<br />PLANNING COMMISSION--. OCTOBER 25, 1988 PAGE 4 <br />Planning Commission believes that the variances should be granted and the <br />developer be allowed to continue on with the proposal. T. Morgan moved <br />to table the request of Suburban Auto Body and Frame until the Board of <br />Zoning Appeals has had an opportunity to review the proposals that are <br />requested, seconded by R. Bierman, and unanimously approved. <br />2) Nightfall Night Club, 30850 Lorain Road <br />Review of site plan (continued from Planning Commission meeting of <br />January 27, 1987 as ordered by the court). <br />Heard by Architectural Board of Review September 21, 1988. <br />Tabled by Planning Commission October 11, 1988. <br />Representative was still not present. Building Commissioner Conway advised <br />that a letter (see attached) had been sent to Mr. Horvath advising that this proposal was to be reviewed this evening. Mr. Conway will advise <br />Mr. Horvath of the next meeting. T. Morgan moved to table the Nightfail <br />request for a review of site plan until'the next scheduled meeting as the <br />owner has not come before the Commission after repeated requests, seconded <br />by J. Thomas, and unanimously approved. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />1) Kenny Lane Pavement Proposal <br />The proposal, by St. Brendan's Church, is to pave a sma.ll section (approxi- <br />mately 60 feet) of Kenny Lane, located at the south end.of a newly <br />constructed church driveway and the west end of Kenny Lane, using construc- <br />tion r.iaterials not in coriformity to city specifications for pavement: <br />Note that I:enny Lane is not currently paved, and is blockecl with posts to <br />prevent "through" vehicular traffic. <br />City Engineer Boyer explained that he does not have the authority to grant <br />a variance to the subdivision regulations and since the Planning Commission <br />originally approved a plan showing this area as concrete and now the <br />developer does not want to use eoncrete, he has referred the plan back to , <br />the Commission. Mr. Dubelko advised that only Council has the authority <br />to grant a variance to the subdivision ordinance. Mr. DelGuidice, repre- <br />senting St. Brendan`s Church, that the entire road will never be installed, <br />but in this small area they would like to use asphalt. He explained that <br />this section of Concord is blocked off from the paved section by posts. <br />which they will move east and install the asphalt in the front of their <br />driveway. It was clarified that this portion of Concord as well as Kenny <br />Lane (Concord runs into Kenny Lane) consists of large rocks and is not a <br />dedicated street. Mr. Boyer explained that this section would basically <br />be a parking lot design and would only be used when church services are <br />held. Neighbors, Mrs. Pracko, Mr. Schall, and Mr. and Mrs. Sevic, had <br />many complaints since vehicles are using the road which is not paved, <br />stirring up dust and scattering stones. Mrs. Pracko who is a resident of <br />Georgette immediately next to Kenny Lane complained that people drive from <br />Georgette onto Kenny Lane every day and she gets no satisfaction from the <br />Police Department and the Service Director does not return her calls. <br />She would like this path totally blocked off from uehicles, Mr. Schall, <br />whose driveway is on the paved section of Concord, would like the entire <br />street paved up to Georgette since the posts that are there have not stopped <br />the traffic. After a great deal of discussion it was determined.that the <br />neighbors had no problem with the asphalt, but they do want to eliminate
