.. <br />BOARD OF ZONING APPEALS AUGUST 3, 1988 PAGE 7 12. Richard Zajak, 6581 Barton Road <br />Request for variance (1123.12). Request 11 foot variance for distance <br />between house and detached garage. Violation of Ord. 87-93, Section 1135.02(c)1. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Zajak and Mr. Johnson, contractor. Mr. Bugala is <br />concerned since there is so much property to the rear of the proposed garage <br />and there would be no difficulty constructing a conforming garage. Mrs. Zajak <br />stated that the adjacent yards were joined :tagether and installing a garage <br />20 feet from the house would break that up. Mr. Zajak stated that their <br />neighbors had no objection to the proposal and they wanted to be able to see <br />their children in the back yard. Mr. Gomersall pointed out that there was <br />a safety factor involved. Mr. Grace believes that since the lot is wide and <br />there is space on either side of the house, there would not be as much of a <br />safety factor and also pointed out that they had an.elaborate swing set <br />structure behind the proposed garage. Mr. Bugal.a cautioned them that if they <br />ever wanted a covered patio they would need another variance. Building Com- <br />missioner Conway advised that if the variance is granted all walls and roof <br />within 20 feet of the house must be covered.with 5/8th inch hard-coat drywall. <br />B. Grace moved to grant the request for an 11 foot variance for the distance <br />between the house and detached garage for Mr. R.ichard Zajak with the condition <br />that 5/8ths hard coat drywall must be installed on all walls and roo£ areas <br />within 30 feet of the structure; seconded by J. Helon.. Roll call on mot.ion:. <br />Grace, Helon, Gomersall, and Remmel, yes. Bugala,"no. Motion carried. <br />Variance granted. Mr. Conway pointed out that a building permit had been - <br />issued for an addition on the same property and if, as shown on the site plan, <br />the front set back of the addition is 99 feet from the side walk a special <br />permit should have been required. He requested that the Board expand the <br />docket to include the special permit for the addition. Board had no problem <br />with that request. R. Bugala moved to grant permission to build an addition <br />99 feet off the front property line as as a special permit to add to a non- <br />conforming structure, seconded by R. Grace, and unanimously approved. Spec.ial <br />permit granted. <br />13. Lena A. Pierson, 28711 Lorain Road <br />Request for variance.(1123.12). Request 4 foot height variance for shed to <br />be moved from 28755 to 28711 Lorain Road. Aiolation of Ord. 87-93, Section <br />1135.02(d). <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mrs. Pierson who explained that this is'an old pump house which <br />she believes may have some historical value and whe would like it moved_to her <br />property. Her lot is about 200 feet deep and she also owns the lot to the rear, <br />and the location of the shed will conform. R. Bugala moved to grant the 4 foot <br />height variance for a shed to be moved from 28755 to 28711 Lorain Road and that <br />it meets all side yard and rear yard requiremens for Lena A. Pierson of 28711. <br />Lorain Road, seconded by J. Helon, and unanimously approved. Variance granted. <br />14. James E. Walters, 5669 Dorothy Drive <br />Request for variance (1123.12). Request 12 foot rear yard variance for patio <br />cover. Violation of Ord. 87-93, Section 1135.08(a). ' Chairman Remmel called all interested parties before the Board. No represen- <br />tative was present. Mr. Bugala stated that there had been a.death in the <br />family. The Board had seen.the property and Mr. Remmel stated that there was
