<br />BOARD OF ZONING APPEALS NOVEMBER 2, 1988 PAGE 4 <br />old building is delapidated. B. Grace moved to grant the request for a <br />variance to replace non-conforming barn in a residential area in violation of <br />Ord. 87-93, since the height of the barn has been reduced to 15 feet and with <br />the condition that the patio area is not enclosed for Mr. Thomas McFadden, <br />26766 Butternut Ridge Road, seconded by C. Remmel, and unanimously approved. <br />Variance granted. <br />9. 28900 Office Park, 28900 Lorain Road <br />Request for variance (1123.12). Request 30 foot rear yard setback variance; <br />request variance to have 30 parking spaces less than required; request vari- <br />ance to have 1 less loading zone than required and also variance for size of <br />the existing loading zone; and request variance for one access onto property. <br />Violations of Ord. 87-93, Sections 1139.05(c); 1161.05(s); 1161.12(e); and <br />1169.09(a). <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to J. Boss, owner,.and W. Giesser, attorney, who explained that <br />the first phase (3 buildings) has been constructed and the second phase is <br />for the remaining two building completing the development. When the origi- <br />nal proposal was presented there was a question as to whether this parking <br />should be figured as five small buildings or on the basis of the development <br />as a whole and was not resolved at the time. 14r. Boss advised that two <br />buildings are occupied and only 20 cars use the narking lot,.and that the <br />rear parking lot is constructed liut is never used and will accommodate the, <br />p.arking for these buildings. Chairman Remmel agreed stating that.he was on <br />the site twice:and the parking lot was not full. Mr. Bugala had a concern <br />about the 30 foot rear yard vaxiance. Mr. Giesser explained that the former <br />Building Commissioner had probably considered the property to be abutting <br />non-residential property which would require a 20 foot rear yard; this land, <br />however, belongs to the school but is zoned residential.. Mr. Boss further <br />advised that he has restricted the types of businesses so they do not generate <br />a lot of traffic and he does not.allow medical offices.. Mr. Bugala suggested <br />that he might sell the buildings. Mr. Boss responded that he is a long time <br />resident of North Olmsted and this complex was built for his retirement, he <br />does not plan to sell. . Regarding the one.,entrance, Mr. Giesser advised.that <br />at the time this was approved, the Planning Commission was trying to restrict <br />the number of drives on Lorain Road wherever possible. Mr. Conway advised <br />that he was not here at that time, but two entrances are required by code and <br />the proposal was never sent for a variance. It was clarified that the plans <br />would be returned to the Planning Commissian.. C. Remmel moved to grant,the <br />30 foot rear yard setback variance; the request to.have 30 parking spaces <br />less than required; the variance to have 1 less 1,oading zone -than required, <br />as well as a variance for the size of the existing loading zone; and the <br />variance for one access onto the property, seconded by B. Grace. Roll call <br />on motion: Remmel, Grace, Gomersall, yes. Bugala and Helon, no. Motion <br />carried. Variances granted. <br />10. Sohio Gas Station, 25295 Lorain Road <br />Request for variance (1123.12). Request 108.92 square foot variance for <br />total sign area to install ground sign. Violation of Ord. 87-93, Section <br />1163.06(d). <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Hixson, Bob Cutler Signs, Councilman McKay, and the operator <br />of the station, Mr. Procaccini. Mr. Grace pointed out that this statio.n had
