PLANNING COtIMISSION SEPTEMBER 12, 1989 PAGE 4 <br />of the property, but it drops down to only approximately a foot and a <br />half on the other side; plans show that land is to be cleared for the <br />future building as well as for a future driveway. Mr. Bowen and Mr. <br />Morgan agreed that they did not want any clearing on the property for <br />future construction. The Commission would also like some kind of a <br />report from the forester regarding the trees. Neighbors, 14rs. Perry, <br />Mr. Lizanich, Mr. Johnson, and Mr. Martin addressed the Commission. <br />They are objecting to any expansion of the parking lot for the Star Lounge <br />which they described as a public nuisance, citing motorcycles being revved <br />up for 15 minutes at a time at 2:30 a.m.; patrons shouting obscenities <br />and threats in the middle of the night; and mentioned the numerous <br />police reports that have been made since this bar has been in operation. <br />They are questioning why a 9 foot high sound barrier is not included as <br />was mentioned at the last meeting, why the business can continue to <br />operage considering the mumber of complaints that have been made, why <br />the residents have to put up with these impossible conditions and they <br />also expressed sympathy for the firemen. in the station next door who <br />also are kept awake. Assistant Fire Chief Osterhouse substantiated all <br />of their comnlaints. It was also pointed out that there was no buffering <br />on the eastern portion of the property at all. Councilman Wilamosky <br />stated that he has had more complaints on the Star Lounge thaiz he has <br />had for any other business in the last 16 years. He requested that the <br />Commission provide as much protection for the neighbors as possible. He <br />further pointed out that the owner has not been cooperating with the <br />city and have not posted their handicapped spaces properly as required. <br />Mr. Nemeth stated that he was given two choices at the previous meeting, <br />either a sound barrier or the mounded landscaped buffer. He also would <br />like the Commission to recommed that the Star Lounge provide some type of <br />security officer in the parking lot. Mr. Kriaris, owner of the Star <br />Lounge, explained that they haue hired a security guard for the parking <br />lot as well as having installed doors and additional glass inside the <br />facility. He maintains that he can do nothing more to control the <br />noise of the motorcycles outside. Mr. Morgan stated that no matter how <br />high a sound barrier is on the rear of th.e property, it will not buffer <br />the noise for residents across Lorain Road. The members agreed that <br />Mr. Nemeth, as the owner of the property, should be able to control his <br />tenants and if not he should be able to break their lease. Assistant <br />Law Director Dubelko advised that it is reasonable for the Commission to <br />require sufficient buffering to mask ordinary and normal sounds that <br />would be coming from a bar of that size and the landscaping and buffering <br />should be tailored to suit such normal sounds, but any unreasonable <br />noise and rowdiness must be dealt with by the Police Department and those <br />complaints should be reviewed at the time their liquor license is up for <br />renewal. Mr. Morgan would like the Commission to be able to re-review <br />this situation after the installation of the buffers in order to ascer- <br />tain their effectiveness and if they are not effective he is questioning <br />if their occupancy can be revoked. In response to the Commission's <br />questions Councilman Wilamosky stated that their license was up for <br />renewal in October. It was also pointed out that if the mounding and <br />landscaping were approved with the condition that the situation would <br />be re-reviewed and it was not found to be acceptable, there would be a <br />considerable additional expense for Mr. Nemeth since he would be expected <br />to install wood sound barriers at that time, In response to questions, <br />Mr. Dubelko advised that the proposal could be delayed fo'r additional <br />input regarcling sound barriers, and to the forester £or his input re- <br />garding trees, etc. Mr. Cesen stated that he could obtain the names of <br />Y . <br />..?
