PLANNING COMMISSION JUNE 27, 1989 PAGE 3 <br />removal of the existing trees, but would like some locust trees planted <br />along the Brookpark Road side of the building. 1.4r. Cody, architect, <br />presented photographs of an existing building at another location as requested <br />by Mr. Sohn of the Architectural Board of Review, and advised that copies <br />had been delivered to Mr. Sohn earlier today. Mr. Betts questioned if any <br />agreement had been reached with Bob Evans regarding rearranging the parking <br />as previously discussed. Mr. Cody advised that no agreement had been reached. <br />In reference to a previous request that some type of deed restriction be <br />placed on this property to prohibit any future use which would generate a <br />high volume of traffic, Mr. Betts explained that the Law Department believes <br />that such a restriction would be appropriate; and also advised that it would <br />be necessary for all parties to agree to this covenant, i.e. Bob Evans, Mary <br />Khouri, and Home Centers. They had also concluded that this restriction <br />could either be a listing of the uses to be permitted on the rear parcel or <br />could be based on a restriction of the amount of traffic any proposed use <br />would generate. He clarified that this whole concept is based upon one <br />entrance onto Lorain Road, and if access were ever granted onto Brookpark <br />Road, a separation of the two parcels would.be required with access onto <br />Lorain Road for the front parcel and access only onto Brookpark P.oad for <br />the rear parcel. If the Commission developes the deed restrictions within <br />this framework, and presents it in writing to the Law Director, he will <br />draft the wording of the covenant. The Commission discussed how to restrict <br />the use and decided that any restrictions should be based on the amount of <br />traffic generated by that use. Mr. Cody suggested that, since in the traffic <br />study they presented, Home Centers fell into the category of furniture/ <br />appliance store as defined in the 1987 Institute of Traffic Engineers Traffic <br />Generation Report, a limitation could be set that no development could exceed <br />that amount of traffic generation as established in that report. Mr. Valore, <br />attorney for the developer, suggested that this could be discussed with the <br />Commission prior to a meeting and they would then present it to Bob Evans <br />and Mary Khouri for their approval. Mr. Betts clarified that there were two <br />separate issues here: the rearranging of the Bob Evans parking for this <br />proposal, and the deed restriction to limit future use; but the deed restric- <br />tion would not change his "no" vote regarding the access through Bob Evans <br />at present. Pir. Betts and another member of the Commission will meet with <br />the Law Department and then meet with the developers prior to the next <br />meeting. M. Betts moved that the proposal for Home Centers, Inc. at the <br />rear of 25853 Lorain Road, proposal to construct a new building, be tabled <br />until the next meeting pending discussion of various terms and conditions, <br />seconded by J. Thomas, and unanimously approved. <br />2) Pizzeria Uno's, 4900 Great Northern Ma.ll <br />Exterior renovation to mall (formerly York's Choices). <br />Heard by the Architectural Board of Review June 21, 1989. <br />Chairman Thomas advised that Captain Krynak had pointed out in the Police <br />Department report that parking spaces in that area are generally filled and <br />patrons will attempt to park in the fire lane when making their orders or <br />pick up. The Fire Department report stated that they had no objection. <br />Mr. Rogawlski, the owner, explained that there was very little take out <br />business at the restaurant. It was clarified for Mr. Bierman that there <br />would be an awning, it was shown on the plans, and a sample of the material <br />was presented to the Architectural Board of Review.
