BOARD OF ZONING APPEALS SEPTEMBER 6, 1989 PAGE 3
his tenants than the building signs and stated that they figured that the
tenants would need 300 feet for their signs. Law Director Gareau stated that
units 13 through 22 would be blocked by the Ohio Bell building next door, no
matter what size signs were installed, but he cautioned the developer, that
if the Board grantea this variance, they might not look favorably on granting
any other variances. Mra Restifo stated that if this is what the developer
,wants, and if he understands what could happen down the road, the board
should grant the variance considering that this is a good looking sign.
Mr. Conway clarified that the sign is not too low, since according to the
code, there is no minimum height unless it is located over a pedestrian
surface. T. Restifo moved to grant the variance for Lauren Hills Shopping
Centers, a request for 204 square foot variance for one side of a pole sign
which includes the supports and canopy, also grant the 2 foot 6 inch variance
for the height of the pole sign, seconded by R. Gomersall. Roll call on
motion: Restifo, Gomersall, and Helon, yes. Mr. Bugala, no. Motion carried.
Variances granted.
5. Christopher M. Hollo, 29440 Bretton Ridge Dr.
Request for variance (1123.12). Request 20 square foot variance for area of
shed., 1 foot height variance and location variance for tool shed. Violation
of Ord. 87-93, Section 1135.02(d)e
Chairman Bugala called all interested parties before the Board. The oath was
administered to Mr. Hollo. Members had no problem with the request. J. Helon
moved to grant to Christopher M. Hollo at 29440 Bretton Ridge Dr, the 20 square
foot variance, the 1 foot height variance, and the location variance for a
tool shed, seconded by R.. Gomersall, and unanimously approved. Variances
granted.
6. Hills Department Store, 26666 Brookpark Road Ext.
Request for variance (1123.12). Request variance to use permanent parking area
for temporary storage structures. Violation of Orda 87-93, Section 1161.03.
Chairman Bugala called all interested parties before the Board. The oath was
administered to Mr. Zwierzynski, representing Hills, and neighbors, r4r. and Mrs.
Simmerly. Mr. Zwierzynski explained that in order to have a more efficient
operation, they want to install a new type of binning in the back storage room
which would necessitate removing all the merchandise and storing it in these
trailers for a period of about 2 months. Mr. Simmerly, a neighbor in the rear,
pointed out that there is one trailer there already with the power hooked up
and he is objecting to any variance being granted because of the condition of
the retention system which is overgrown with weeds and full of debris and also
the mounded landscape area which is overgrown. Chairman Bugala is also concerned
since he believes that -Bryant and Stratton would need the parking that these
trailers will be taking up. Mr. Zwierzynski pointed out that Hills did not own
the building that they were merely leasing it, but they would contact the owner
to ha.ve the retention system and the landscaped area cleaned up. Mr. Restifo
asked if he would commit to cleaning the property if the owner did not. After
some discussiori, Mr. Zwierzynski agreed that if the owner did not take care of
the problem, Hills would and charge it back to the owner. He futher advised
that-:all the trailers would be gone in 2 months and that there was no signifi-
cant power to these trailers, only one cord for the security system. Law
Director Gareau advised that there is an ordinance which regulates the mainten-
ance of retention systems. R. Bugala moved to grant the temporary (8 week)
