r . - ,,14 <br />BOARD OF ZONING APPEALS AUGUST 2, 1989 PAGE 2 <br />to continue the variance for 1 year. Mr. Welke stated that they would probably <br />onl}T need it for 3 to 6 months. Councilman Wilamosky pointed out that the sign <br />had been there for 7 months and he is asking the Board to reject the request <br />even for the 3 months, mainly because the developer has not cleaned the ditch <br />behind the property as had been stipulated with the original approval of this <br />project. Mr. Welke advised that originally they did clean the ditch, but <br />the residential property owners on the other side of it have been dumping <br />grass, and the tenants of the shopping center to the west have been letting <br />garbage and debris blow into it and driving trucks over their grass. Mr. <br />Wilamosky believed that the shopping center was cleaning up their property <br />somewhat. He believes that this should be a give and take situation and the <br />developers should show some good faith, especially with the recent flooding <br />situation. Councilman Bohlman stated that-the residents have been complaining <br />about the condition of the ditch and the original approval called for a fence <br />along the entire rear portion of the property; There is 35 feet of this <br />fence missing and he has been told by-:.the Engineering Department that this <br />was to allow for entrance of vehicles and pointed out that a gate could always <br />be installed. Law Director Gareau stated that it is not in the best interest of <br />the City to have the ditch not cleaned, and it is not in the best interest of <br />the City to have those stores and offices remain vacant and suggested that <br />the matter be tabled until the next meeting at which time the ditch should be <br />cleaned and the fence replaced. Mr. Welke agreed that the original plan did <br />show a fence across, but the Engineering Department requested that they_put <br />another drain in the area and sTant it in order to have an overflow. He further <br />stated that he would like a fence down the side line to block the view. Chair- <br />man Bugala moved that this request be continued with the understanding that the <br />situation of the fence and the.ditch will be addressed and agreed upon and in <br />the ensuing time the sign can remain, seconded by R. Gomersall, and unanimously <br />agproved. Request continued. <br />1. Hills Department Store, 2666 Brookpark Road Ext. <br />Itequest for variance (1.123.12). Request 257.14 square foot variance for total <br />sign area to install wall signs. Violation of Ord. 87-93, Section .1163.06(d). <br />(Previous variance granted November 2, .1980). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Ms. Riley and Mr. Jenkins, contractors, and Mr. Zwierzynski <br />and Mr. Kier, both representing Hills. Mr. Bugala stated that an adjacent <br />neighbor, Mrs. Furman, 26749 Leenders Lane has advised -that she is totally <br />opposed to this variance. Mr. Zwierzynski explained that Hills is now operating <br />about 36 stores in Ohio and they are requesting to be allowed to use their <br />standard logo at this location. He explained that when they first moved into <br />the Gold Circle stores they used the existing sign boxes in order to have <br />identification immediately, and they are now in the process of changing signs <br />in 7 locations. In response to the Board's questions, Mr. Conway advised <br />that the present signs are:?120 square feet each and the proposed signs are 226 - <br />squar.e feet each. Chairman Bugala pointed out that they already had a variance <br />for an off site pole sign as well as approximately 50 square feet of sign area., <br />Mr. Gomersall stated that these signs are very similar, only larger;, and <br />many businesses have had to reduce their signage, Mr. Zwierzynski explained <br />that the variance for the off site sign was granted because the store was not <br />on the main street, and that their logo has a large "H" which would be impos- <br />sible to do in a boxed sign.
