. _01 . • <br />BOARD OF ZONING APPEALS JULY 12, 1989 PAGE 3 <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Gedeon and Mr. Zieleski, contractor. Mr. Grace took ex- <br />ception to the statment on Mr. Gedeon's appeal form that havingto appear before <br />the Board was an undue hardship. Mr. Grace stated that he does not believe <br />requiring a SO foot rear yard could be considered a hardship. Members had <br />no objection to the request. T. Restifo moved to grant the 12 foot 6 inch rear <br />yard set back to install a patio enclosure at 24786 Randall Drive, the Gedeon <br />h:ome, seconded by J. Helon, and unanimously approved. Variance granted. <br />8. Rob Button, sublot 2 Root Road (property located between 4302 and 4324 Root Road). <br />Request for variance (;1123.12). Request 18 foot front set back variance (in <br />excess of maximum of 70 feet) to construct new dwelling. Violation of Ord. <br />87-93, Section 1135.06(a). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Streeter, contractor, Ms. Schulz, Mr. Kenzig, Mr, and 1-4rs. <br />Nesser, and P4r. Sherwood, neighbors. Mr. Streeter presented plans for neighbors <br />to see and advised that they would like to place this house between the set <br />backs of the two adjacent houses. He believes that if they put the house at the <br />70 foot set back it would be out of line with the others in the neighborhood. <br />Neighbors are concerned because this lot is low and usually covered with water. <br />They would like to make sure that this water is not drained onto their properties. <br />Mr. Streeter advised that there would be a yard drain and a swale and the water <br />would be drained out to the ditch. Building Commissioner Conway advised that <br />that all water must be contained on the property, that the drive can be con- <br />structed to the property line, but it must be pitched to the middle so that water <br />will drain off to the ditch. Law Director Gareau advised that.this was not the <br />issue before the Board, and that even if the set back conformed these same <br />objections would apply. P4r. Kenzig stat.ed he is also.objecting to the set back <br />and pointed out that the the house next door to this one is the only house on <br />the street that is set back that far. R. Gomersall moved to grant tlie 18 foot <br />front set back variance (in excess of maximum of 70 feet) to construct a new <br />dwelling tor Rob Button, sublot 2 Root Road (property located between 4302 and <br />4324 Root Road, seconded by T. Restifo, and unanimously approved. Variance <br />granted. <br />9. Norma Cook, 23112 Virginia Ave. <br />Request for variance (1123.12). Request 7 foot 2 inch front set back variance <br />to construct an addition. Violation of Ord. 87-93, Section 1135.06(a). Also <br />request special permit to add to non-conforming dwelling. Special permission <br />required Ord. 87-93, Section 1165.02. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mrs. Cook, Mr. Springer, the contractor, and neighbors, Ms. <br />Benden, Mr. and Mrs. Garden, and Pis. Cameron, all of whom came in support of <br />Mrs. Cook's request. T. Restifo moved to grant the request of Norma Cook at <br />23112 Virginia Avenue, the request for. a 7 foot 2 inch front set back variance <br />to construct an addition and also to grant the special permit, seconded by <br />B. Grace, and unanimously approved. Variance granted. <br />10. Bentley Coe Plaza, 24131 to 24213 Lorain Road <br />Request for variance (1123.12). Request variance to install 2 ground signs on <br />one property. Violation of Ord. 87-93, Section 1163.06(b)2.
