<br />BOARD OF ZONING APPEALS JUNE 7, 1989 PAGE 3 <br />Mr. Daniel Gaul, 5609 Columbia Road, seconded by J. Helon, and unanimously <br />approved. Variances and special permit granted. <br />7. Developers Diversified, property located at 25420 Butternut Ridge Road. <br />Request for variance (1123.12). Request variance to eliminate requirement for <br />a garage (previous out building demolished). Violation of Ord. 87-93, Section <br />1161.08(a)-1m <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Franz, representing Developers Diversified, and neighbors, <br />Mr. Crabs and Mr..Schulz who is questioning what hardship was involved in <br />this request. Mr. Franz advised that they removed the garage/barn on the pro- <br />perty which was in bad condition, and that since this house is being r.ented <br />at a nominal rent and will be torn down in the future, they are requesting a <br />variance so they will not have to have a garage. He stated that this property <br />is the location of the recreational area on the.multi family portion of their <br />development, and the house will probably be taken down, but this was not <br />clearly addressed at the time of the court judgement.. He maintained that if <br />they do not get the variance, they will tear the house down immediately. <br />Law Director Gareau clarified that this portion of the property was designated <br />to be used for recreational purposes and that his recommendation would be to <br />grant the variance since to tear the house down earlier would not make sense. <br />Mr. Schulz objected since in another instance a resident had been forced to <br />build a garage and these people, who have been very poor neighbors in the <br />past and who have the money to build a garage, will not be required to have <br />a garage. Mr. Schulz gave a history of the problems the-neighborhood has had <br />with the developer's'properties, and pointed out that the debris from the barn <br />is still on the property.. Mr. Franz stated that the debris has been removed <br />and the tenant does not need a garage. Mr. Restifo is concerned that the <br />Board might be setting a precedent. It was decided that a one year time limi- <br />tation should be stipulated. J. Helon moved to grant the request for a variance <br />to eliminate the garage for one year for Developers Diversified, 25420 Butternut <br />Ridge Road, seconded by R. Gomersall. Roll call on motion: Helon, Gomersall, <br />and Bugala, yes. Mr. Restifo, no. Motion carried. Variance granted. <br />8. Kellers Jewelry, Inc. 26626 Lorain Road <br />Request.for variance (1123.12). Request 41 square foot variance for total sign <br />area to install wall sign and to add to pole sign (pole sign will conform). <br />Violation of Ord. 87-93, Section 1163.06(d). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Ms. Riley, from Permits Plus who is representing the owner, <br />Mr. Bugala stated that he had a problem since the wall sign would overlap. <br />onto the adjacent store front. Ms. Riley stated that the landlord and the <br />lessee had no objection. In response to Mr. Bugala's questions, Building <br />Commissioner Conway advised that they would be adding a 2 foot by 6 foot sign <br />to the pole sign.and that a variance would still be needed for total sign <br />area for just the pole sign. Mr. Bugala believes that both of the signs <br />should meet code. R. Bugala moved that for Keller's Jewelry, 26626 Lorain <br />Road, the variance be granted for 41 square foot for total sign area to <br />install a wall sign and to add to a pole sign, seconded by T. Restifo. Roll <br />call on motion: Bugala, Restifo, Helon, and Gomersall, no. Motion failed <br />to pass. Variance denied. .
