BOARD OF ZONING APPEALS <br />JUNE 7, 1989 <br />9. Elizabeth and Edward Filina, 24138 LeBern Drive <br />Request for variance (1123.12). Request 40 square <br />height variance for tool shed. Violation of Ord. <br />PAGE 4 <br />foot variance and 3 foot <br />87-93, Section 1135.02(d). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Filina who explained that the shed would be 10 <br />by 14 feet and that the height was necessary because of the shape of the shed. <br />R. Gomersall moved to grant the request for a 40 square foot variance and a <br />3 foot height.variance for a tool shed for Elizabeth and Edward Filina, 24138 <br />LeBern Drive, seconded by T. Restifo. Roll call on motion: Gomersall, Restifo, <br />Bugala, and Helon, no. Motion failed to pass. Variance denied. <br />10. Alex and Rose Balazs, 26200 Walnut Lane <br />Request for variance (1123.12). Request location variance for tool shed. <br />Violation of Ord. 87-93, Section 1135.02(d). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mrs. Balazs who explained that there lot slopes down in <br />the rear is is frequently flooded. Mr. Conway stated that because of the <br />flood plane he would prohibit a shed being built in a conforming location. <br />Mrs. Balazs pointed out that the shed is behind the garage and is not visible <br />from the street, and when she bought the property she was not aware that the <br />rear of the lot would be flooded. Mr. Gonersall stated that these were exten- <br />uating circumstances. T. Restifo moved to grant the location variance for the <br />tool shed for Alex and Rose Balazs at 26200 Walnut Lane, seconded by J. Helon. <br />Roll call on motion: Restifo, Helon, and Gomersall, yes. Mr. Bugala, no. <br />Motion carried. Variance granted. <br />11. i4r. and Mrs. Alan Tuuri, 23380 Marion Road <br />Request for variance (1123.12)a Request 6 foot variance between addition and <br />detached garage. Violation of Ord. 87-93, Section 1135.08(a). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Turri, his contractor, Mr. Redinger, and a neighbor, <br />Mr. Furlin. 14r. Redinger stated that there is-now fire rated drywall in the <br />garage. Mr. Furlin is concerned that his garage would be too close to the <br />addition, but it was determined that his garage was further back than Mr. Tuuri's <br />and there would be no problem. J. Helon moved to grant a 6 foot variance <br />between the addition and detached garage for Mr. and A'Irs. Alan Tuuri, 23380 <br />A4arion Road, seconded by R. Gomersall, and unanimously approved. Variance <br />granted. <br />12. Pete and Nancy Toth, 24$87 Mitchell Drive <br />Request for variance (1123.12). Request 21 foot rear yard variance to install <br />screen room. Violation of Orda 87-93, Section 1135.02(a). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Toth and their contractor, Mr. Rounda Members <br />stated no objections. R. Gomersall moved to approve the request for a 21 foot <br />rear yard variance to install a screen room for P_ete and Nancy Toth at 24887 <br />Mitchell, seconded by J. Helon, and unanimously approved. <br />.
