` <br />PLANNING COMMISSION MARCH 13, 1990 PAGE 4 <br />required and the frontage of sublot 3 is 70 feet, however, the frontage <br />is not effected by the assembly since the property is being added to the <br />rear of the sublots. He further explained that the original lot had been <br />separated by I-480 and that the owners are merely squaring off the Mastic <br />Road portion, but they were required to join the portion across I-480 to <br />a lot that they owned facing Columbia Road in order to eliminate a land- <br />locked situation. Mrs. Watts, representing J.P.N. Corporation,.explained <br />that they are splitting off the two rear sections of the lot and selling <br />them to the two adjacent property owners and will be selling the main por- <br />tion of the lot. The portion of the lo.t across I-480 will be assembled <br />to another lot they own facing Columbia Road.as required by the city in <br />order not to have a landlocked lot. It was clarified for a neighbor that <br />the larger parcel was being squared off and could be subdivided later, <br />but that was not part of this request and if it is.done in the future, <br />it would have to be approved by.the Planning Commission. The proposal " <br />was explained to Mr. Sponseller, an adjacent resident, and another neighbor, <br />speaking from the audience, questioned why this was being approved when <br />the rezoning across the street had been tabled. Chairman Thomas explained <br />that the property owner has a rigYit to subdivide his property and the sub- <br />division should not have any bearing on the proposed rezoning. M. Betts <br />moved to approve the proposal to subdivide permanent parcel 237-19-20, <br />located on the north side of Mastick Road, east of Columbia Road, into <br />four (4) sublots. Included in this proposal are permanent parcel numbers <br />237-19-2, 237-19-22, and 237-19-26, as submitted, seconded by R. Bierman, <br />and unanimously approved. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1) Darby 0'Toole's, 24280 Lorain Road , <br />Exterior renovation to building. <br />Mr. Kelly, the owner, present the proposal to add false plexiglass windows <br />and wood siding. It was clarified that there was another vacant building <br />behind this structure and an occupied house behind that. Building Commis- <br />sioner Conway stated that he has not verified if parking conforms to.code <br />since there has been no change in use and he doubted that there would be <br />any records regarding the original occupancy of the building. Mr. Kelly <br />estimated that they had 150 seats. Mr. Conway advised that their parking <br />was probably under the requirements, but noted that he had no Complaints <br />on this facility. Mr. Kelly stated that they did have an agreement with <br />the adjacent business, Rad Air, to park in their lot on weekends. Assistant <br />Law Director Dubelko advised that if there are records available regarding <br />the number of seats approved under the original occupancy and it could be <br />determined if seats had been added, the management could be required to <br />either reduce their seating or increase their parking. He further stated <br />that he had seen this parking lot and Rad Air's totally full with cars <br />spilling over into the parking lot across Lorain Road. In reference to the <br />plans, Mr. Kelly stated that there will be lighting under the soffit, but <br />the canopy would not be lighted. Mr. Conway pointed out that there is a <br />base to an old sign or light on the property and he would like the Commis- <br />sion to require its removal as a condition of this approval.
