Mr. Bollinger clarified that regardless of 2%2 or 3 stories <br />the number of residents will be the changed. Mr. Reagan was sworn in at this <br />time who stated that he thought this had been decided upon years ago. Building <br />Commissioner Conway explained that there was a proposal years ago for <br />condominium which was never developed, and this is a totally different <br />development. He further stated that the height issue should really be addressed <br />by the Planning Commission and Architectural Review Board and if they determine <br />that the building would look better with the higher roof line, they could send <br />it back to this Board. The Board tonight is Just addressing if the lower floor <br />should be below ground. Mr. Grace agrees that the units should not be below <br />ground. B. Grace moved to grant a variance for a 3 story walk up apartment <br />building instead of 2z stories which will meet code at 35 feet, seconded by T. <br />Restifo, and unanimously approved. Variance granted. In reference to the <br />ruling regarding parking cars for a Multi-family development on land zoned for <br />Single Family Use, Mr. Grace stated thaCas long as there are only 10 spaces and <br />the cars are headed away fr-am the single family area, he would have no <br />objection. Mr. Bollinger pointed out that there would also be tree buffer <br />between the parking area and the residences. Mr. Gomersall believed that this <br />would negate the.purpose of the Zoning Code because it would allow the developer <br />to build more apartments on the land. Mr. Conway ciarified that he had <br />requested a ruling as to whether multi-family parking would be allowed on land <br />zoned for single family, and if the Board ruled that it would be this would be <br />in all instances, not just for this development. Mr. Grace would he in favor of <br />this for just 10 spaces for this development, but not for the entire city. Mr. <br />Bollinger stated that they did have an area for more pa.rking, this plan was <br />better for traffic flow. He pointed oiit that of they applied for rezoning, they <br />would ask for a rezoning of the entire single family area and they would be able <br />to put another 16 units on the property. The members stated that it would not <br />likely be approved. B. Grace moved that the Board rule that parking for a <br />multi-family development is not permitted on property zoned for single family, <br />seconded by T. Restifo. Roll call on motion: Grace, Restifo, Gomersall, Helon, <br />and Bugala, no. Motion failed to pass. <br />9. Warren A. Wellits, 5601 Quail Run. <br />Request for variance (1123.12). Request 20 square foot area variance, 4 foot <br />height variance and location variance for tool shed. Violations of Ord. 87-93, <br />Section 1135.02=(d)l. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Wellits. Law Director Gareau advised that the new ordinance <br />on sheds has passed. Members agreed this would probably fall into the <br />guidelines of the new ordinance. J. Helon moved to grant the variance for <br />Warren A. Wellits, 5601 Quail Run, the request for a 20 square foot area <br />variance, 4 foot height variance and location variance for tool shed, seconded <br />by R. Gomersall, and tmanimously approved. The oath was <br />administered to Mr. Varga who presented a letter from the neighbor to the east, <br />5
