..-- , • <br />4. Richard T. Ba.rber, 3320 Cla e Road. <br />Request for variance (1123.12). Request 3 foot si.de setback variance and 3 <br />foot rear setback variance to construct detached garage. Violation of Ord. <br />87-93, Section 1135.02(c)l. <br />Chairman..Bugala called all interested parties before the Board. The oath <br />was administered to Mr. Barber, the owner, and a neighbor, Mrs. Barnes-Filo <br />who is opposed to the request because, since the old non-conforming garage was <br />demolished,she believes that the new garage should conform. She stated that <br />Mr. Barber would like to build on the existing slab, but since he has <br />purchased several rental properties she does not believe that it would be a <br />hardship to extend the existing slab. She has been told that this would be <br />problem when she wanted to sell. Mr. Grace stated that if the slab was <br />extended, it would not be a solid foundation. Mr. Ba.rber maintained that he <br />plans to live in the house; that the garage was tom down prior to his <br />purchasing it; that 2 trees would have to be removed to extend the slab; and, <br />as a real estate agent, he does not believe this would hinder a sale. The <br />garage next door lines up with his foundation. Mr. Grace believed that it <br />would be a hardship to have to put 2 feet onto an existing slab, and <br />questioned what could be done with the extra 2 feet. Mr. Bugala has a problem <br />with this since the neighbor objects. Mr. Barber questioned if he could <br />compromise with: her., J. HeTon, moved to grant the variance to Richard T.. <br />Barber, 3320 Clague Road for a 3 foot side setbaek variance anda 3 foot rear <br />setback variance to: construct detacfied garage-, Mr. Barber pointed out that <br />there were 2 variances. Mr. Graee had no.problem with either variance. <br />Motion was seconded by J. Helon. Roll call on motion: HeTon and Bugala, m. <br />Mr. Grace, yes. Variance denied. Mr: Barber was advised that he eould appeal <br />to Common Pleas Cour•t. <br />5. Med Center, 25757 Lorain Road. <br />Request for variance 1123.12 . Request variance to use temporary banner for <br />advertising. Violation of Ord. 87-93, Section 1163.06(e)-4. <br />Chairman Bugala ca.lled all interested parties before the Board. The oath was <br />administered to Ms Grace, representing the Med Center,. who explained that the <br />size of the banner has been reduced to 3 by 6 feet instead of 3 by 12 feet. <br />Mr. Bugala stated that he had voted against the varianee that they had <br />requested'_a few months ago and he could not vote for this one. He stated that <br />this is a temporary sign which, is not allowed, and it would seem to be a <br />permanent sign. Ms Grace explained that this sign is for a different <br />promotion and the other was requested several months ago. Mr. Grace pointed <br />out that temporary signs have been granted before for shopping centers and <br />that all grocery stores have temporary signs. R. Bugala moved to grant the <br />variance to use a temporary banner for advertising for Med Center at 25757 <br />Lorain Road, seconded by B. Grace. Roll call on motion: Bugala ancl Helon, no. <br />Mr. Grace, yes. Motion failed to pa.ss. Variance denied. <br />6. Josef Kubelka 4986 Ham ton Dr. <br />Request for variance 1123.12 .. Request 17 square foot variance and 3 foot <br />height variance to construct shed. Violation of Ord. 90-76, Section <br />1135.02-(D)-1. <br />Chairman Bugala ca.lled all interested parties before the Board.
