the Commission could not base their decision on this, but the developer should <br />be aware of it and the decision of the Board of Zoning Appeals could be <br />effected since the structure would be closer to the right of way after the <br />widening. Mr. Scheel stated that this could make the property unusable. Mr. <br />Coburn advised that there would be nothing in the lease that would allow them <br />to acquire more property, even if this happens, and that if they could <br />continue at this location for 5 years, they could probably recoup their <br />investment for this renovation. The representatives further stated that <br />updating this station was in keeping Frith the industry's trend of renovating <br />a11 facilities; that what is being proposed is in keeping with the size of the <br />site; that this change will keep them competitive, but will not increase the <br />traffic flow on the site; and they would probably do the re-striping of the <br />adjacent lot themselves. Mr. Deichmann advised that a letter has been sent to <br />the owner of the larger parcel citing several violations of the property <br />maintenance ordinances including the striping, but there has been no response <br />as yet. In reference to forcing the owner of the property to lease more area, <br />Assistant Law Director Dubelko advised that since there are separate owners, <br />he thinks there might be a problem, however he would really have to study both <br />leases to decide what could be done, but having access from one lot to another <br />could give the city some authority to get something done on the adjacent lot. <br />He also believed that the Commission could eliminate the access if they were <br />not willing to comply with the Conunission's requests. Mr. Gorris requested <br />that the Building Department bring any plans to the next meeting that are on <br />file for the adjacent property, probably those submitted when Chuck E. Cheese <br />was approved; and at that time he would like an update as to whether or not <br />there has been a response from the landlord, and if not what action is to be <br />taken. B. Gorris moved to forward the Shell Oil Company site plan for the new <br />food mart, canopy, and dispensers at Lorain and Clague Road to the <br />Architectural Review Board for their input; to the Safety Department for their <br />input; we would like for the Building Department if possible to find any plans <br />as they relate to the adjacent development that would show parking and/or <br />striping; we would also like to lmow at the next meeting if the landlord has <br />responded to the City's request to address the deficiencies on the lot; and <br />further request that the developer to pursue with the owner of the property <br />the striping and the internal traffic flow to coincide with what could be an <br />increase in the traffic flow of the egress from the easterly lot line through <br />the larger property, seconded by T. Morgan, and unanimously approved. <br />3) Horizons Activities Center, 26272 Butternut Ridge Road <br />Proposal to erect a pavilion. <br />Mr. D. Smith, Development Director of the Horizons Activity Center, explained <br />that this is their second site which is being leased from the City and is <br />now being used as a pre-school for handicapped children between 2-2 and 6 <br />years old. They are building the pavilion under a commt,n-ity block grant and <br />it is to be used for sumuner activities for handicapped children and impaired <br />senior citizens. Mr. Gorris questioned if this is a permitted use in a <br />residential district. Assistant Law Director Dubelko clarified that the <br />Zoning Code provides specifically that the City is not subject to its own <br />zoning laws, but will look into whether or not a lessee would have the same <br />benefits as the City would have. The pavilion will be 30 by 50 feet with 4 by <br />8 feet openings which wi11 be screened. They are also going to develop a <br />handicapped park and nature trails in the back of the property.
