Brookpark right-of-way, pine trees on either side of the property with <br />landscaping adjacent to the drive and grass on the balance of the area. <br />Regarding the small area between the sidewalk and retaining wall on Lorain <br />Road, the asphalt will be removed and some kind of plant material will be <br />installed, even though they have been advised that the area is too small to <br />support growth. On the north elevation the indented area of the building will <br />be infilled and a loading dock and ramp will be added. Between T.J. Maxx and <br />the proposed Sun T.V. unit there is now a metal panel which will be changed to <br />white brick. Mr. Betts pointed out that in the past there was a reaction from <br />the public about electric colors, and is concerned that these colors could <br />create the same negative response. Mr. Stark stated that he was willing to work <br />with the Architectural Board on this issue, but pointed out that this was a <br />contemporary concept and will be tying the entire center together. In reference <br />to getting approval from the State for the access onto Brookpark Road, he <br />explained that they started about 30 years ago, after a traffic light was <br />installed for the May Company access, there was little reason to refuse the cut <br />across from it since the traffic was stopped at that point anyway. He agreed to <br />tell the Commission the cost of the curb cut after the meeting when it would be <br />off the record. Since the Commission is in the_process of developing a Master <br />Plan for the city, Mr. Thomas questioned how the developer would feel about a <br />ring road being created in order for other properties to use this access. Mr. <br />Stark objected on the basis that this would be a taking, considering the costs <br />incurred, not only for the cut itself but for legal fees and other costs over <br />the years, as well as the ongoing costs of maintenance, etc. He does not <br />believe that there was a precedent set with this cut, since it was granted on <br />the basis of the exi.sting traffic light. In reference to having his property <br />connected to a ring road that was on other properties, he advised that neither <br />his lessees nor his mortgagee would allow it, and believed that the layout of <br />the buildings would prohibit it. If this saa.s required for new construction it <br />would be a totally different matter. He suggested that an access lane might be <br />constructed on the Brookpark right-of-way. Again in reference to the procedures <br />involved in obtaining a curb cut onto a limited access road, he explained that <br />the action was initiated by the Nlayor's office during several administrations, <br />but it was during Mayor Swietynowski's administration that it was finally <br />approved. Assistant Law Director Dubelko did get some conflicting information <br />regarding this and would re-review his notesa Mr. Skoulis noted that a cut has <br />been allowed for a Biskind property and it appeared it was merely requested by <br />the Mayor without any approval from Council or Planning Commission. Mr. Betts <br />stated that it appeared that the State ha.d conducted a stringent review process <br />in Mr. Stark's case. City Engineer Deichmann will research exactly what curb <br />cuts have been allowed on both Brookpark Road and the limited access portion of <br />Great Northern Boulevard. The members will study this further during their <br />study of the master plan. Regarding this development, Mr. Stark advised that <br />there are no plans for signage on the rear of the adjacent bank building. In <br />reference to traffic flow, Mr. Stark stated that he did not anticipate a great <br />deal of traffic from Lorain Road cutting through his lot to Great Northern Mall <br />and that engineering plans would address the enclosing the swale. Building <br />Commissioner Conway advised that the proposed drive conforms to code. Is is not <br />likely that the State of Ohio would object to their planting trees in in the <br />right of way. Mr. Stark explained that he purchased the former A.T.T. <br />transformer property and will be combining it with the other property. In <br />regard to the parking requirements, Mr. Stark stated that there is less than <br />required by the City's code, but this does comply to the industry standards and <br />will allow for some green area.
