<br />S. B.P. Oil Company, 23425 Lorain Rd. (both cases called together). <br />Request for variance (1123.12). Request 22 square foot variance for total sign <br />area to install 2 logos on ptnnp canopies. Violation of Ord. 90-125, Section <br />1163.12(j). <br />6. B.P. Oil Company, 25295 Lorain Road. <br />Request for variance (1123.12). Request 22 square foot variance for total sign <br />area to install 2 logos on pump canopies. Violation of Ord. 90-125, Section <br />1163.12(j). <br />No representative presented. Request delayed Lmtil the end of the meeting. <br />7. Jeffrey and Beth Ann Sedam, 24883 Tara Lynn Drive. <br />Request for variance (1123.12). Request 3 foot, 6 inch rear yard variance to <br />construct patio enclosure. Violation of Ord. 90-125, Section 1135.08(a). Also <br />request 2 foot 6 inch side yard variance for side porch and steps. Violation <br />Violation of Ord. 90-125, Section 1135.07. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. Adamescu, contractor, who explained plans for the porch <br />enclosure. Building Commissioner Conway clarified the variance for 3 foot, 6 <br />inches was to the open deck. The members had no problem with the request. B. <br />Grace moved to grant the request for a 3 foot, 6 inch rear yard variance to <br />construct gatio enclosure and a 2 foot, 6 inch side yard variance for side porch <br />and steps for Jeffrey and Beth Ann Sedam, 24883 Tara Lynn Drive, seconded by B. <br />Gomersall, and lmanimously approved. Variances granted. <br />8. Danny Boy Farm Market, 24579 Lorain Road. <br />Request for variance (1123.12). Request 57 foot front setback variance (at <br />closest point) and 38 foot side yard variance (at closest point) to construct <br />permanent enclosure which was previously enclosed by a temporary structure <br />between November lst through May 1st. Violation of Ord. 87-93, Sections 1139.07 <br />and 1139.02. Also request special permit to add to non conforming building. <br />Special permit required Ord. 90-125, Section 1164.02. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to T. Romp, the owner, and Mrs. Siebert, a neighbor. Mr. Romp <br />advised that for the last 10 years this area had been enclosed with a temporary <br />structure from October through April and left open in the simmier. During the <br />re-construction (after a fire) they would like to enclose this permanently so <br />that the whole area can be air conditioned. He stated that this enclosure will be <br />in line with Dairy Queen next door. Building Commissioner Conway clarified that <br />the new code required a 75 foot front set back, and originally it was 50 feet. He <br />also pointed aut that the foot print of the building would not be increased. Law <br />Director Gareau pointed out tha,t previously a 35 foot setback had been alTowed if <br />there had been no parking in front. The members agreed that this was really not <br />changing anything. It was clarified for Mrs. Siebert tha.t a setback was required <br />in order to keep the buildings tmiform. Mrs. Siebert stated that she merely <br />wanted to know what was going to be done and had no corrunents. T. Restifo stated <br />that he would like to make a motion for Danny Boy's Farm Market at 24579 Lorain <br />Road, to approve a 57 foot front setbaclc variance and a 38 foot side yard <br />varianee to construct a permanent enclosure which was previously enclosed by a <br />temporary structure, and also to approve a special permit to add to a non- <br />conforming building, seconded by B. Grace, and unanimously approved. Variance and <br />special permit granted. It was clarified for Mrs< Siebert that a special permit <br />was required to add onto any non-conforming building, it was not a permit to <br />build a separate structure. <br />3 ? ?
