Request 5 foot rear yard variance and 546 square <br />foot variance for garage area to construct detached garage (400 square foot garage <br />is existing and new garage will be 896 square foot). Subdivision and assembly plat <br />wi71 be submitted to Planning Corrnni.ssion after approval of the Board of Zoning <br />Appeals. Variance will also be required for one sublot. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mrs. LeBlanc and her son, A. LeBlanc, and Mrs. Oldack, a <br />neighbor. Mr. LeBlanc explained that he planned to store antique cars in the <br />garage. Building Commissioner Conway stated that there was also a variance needed <br />for the distance from the house to the garage. He further explained that Mr. <br />LeBlanc and Mrs. Oldack would also be trading property so that there will be no <br />side setback variance required, but this will have to go to the Planning <br />Commission for a subdivision and assembly. He suggested that the Board grant a 2 <br />foot side yard variance just in case the subdivision is not approved. Mrs. Oldack <br />had no objection to the garage being that close to her property. If this does go <br />to Planning Commission, it must be returned to this Board. for a variance. B. <br />Grace moved to grant the request for a 5 foot rear yard variance, 546 square foot <br />variance for garage area to construct detached garage (400 square foot garage is <br />existing and new garage will be 896 square foot); also to grant a variance for 15 <br />foot clearance between home and garage and a 2 foot side yard variance between <br />the existing property line and the garage, with the condition that there must be <br />a fire wall in the garage in any area that is less than 15 feet from any dwelling <br />and also with the condition that thi.s is to be used strictly for the storage of <br />antique collectable cars for Andre LeBlanc, 30447 Lorain Road, seconded by R. <br />Gomersall, and imanimously approved. Variances granted. <br />10. Wayne C. Parker, 5692 Dorothy Drive. <br />Request for variance (1123.12). Request variance to keep oversized recreationa.l <br />vehicle (over 18 feet in length) in rear yard. Violation of Ord., 90-125, Section <br />1135.02(h). <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. and N1rs. Parker and Mr. Euller, a neighbor, and his daughter. <br />Law Director Gareau advised that previously a recreational vehicle of any size <br />could be stored on the side or rear of the owner's property. The new code now <br />stipul..ates no recreational vehicle over 18 feet long can be parked on residential <br />property, thus eliminating almost all recreational vehicles. Council was unaware <br />of this section of the new code. Mr. Gareau is concerned about a recreational <br />vehicle, over 18 feet, that was stored on the owners property prior to the codes; <br />what happens to its non-conforming status. The Council is studying this now, and <br />he has suggested that the Building Department stop citing these violations until <br />a determination has been made. They are considering regulating the size allowed <br />on the property in relation to the size of the lot. Neither does he lmow how <br />limiting a vehicle to 18 feet would relate to the public health, safety, and <br />welfare of the residents. Mr. Parker pointed out that he also owns a separate <br />lot. Mr. Euller, who lives behind this property, questioned if this is granted <br />would it be specifically for this one instance. He was advised that a variance <br />would pertain only to this request. Mr. Euller had no objection since he cannot <br />see it fron his house. Mr. Conway advised that, since the ordinance is under <br />discussion, these violation proceedings would be held up, and the Building <br />Department will not be citing other violations until this is resolved. R. <br />Gomersall moved to grant the request for a variance to keep the oversized <br />recreational vehicle (over 18 feet in length) in the rear yard of Wayne C. <br />Parker, 5692 Dorothy Drive, seconded by B. Grace and unaniniously approved. <br />Variance granted. <br />4
