Mr. Sala <br />had no objection to the room addition, but is concerned about the garage door <br />since there is only 72 feet between the corner of Mr. Davison's house and Mr. <br />Sala's property line and there would be no room to drive a vehicle beside the <br />house. Mr. Davison needs the garage door for his lawn equipment, he does not plan <br />to park a car in this addition. T. Restifo moved to grant the Davison Family at <br />3534 Dawn Drive, the request for a 1.5.foot side yard variance and a 17 foot rear <br />yard variance to construct an addition with the condition that this addition, not <br />at any time, will be used for any automobiles, trucks or that type of vehicle, <br />seconded by R. Gomersall, and Lmanimously approved. Variances granted. <br />14. Office Warehouse. 4706 Great Northern Blvd. <br />Request for variance (1123.12). Request 38.5 square foot variance for total sign <br />area to construct pylon sign. Also request a variance to advertise one business <br />in shopping center on this sign and 10 foot variance for the location of sign <br />(encroachment of setback from right-of-way). Violations of Ord. 90-125, Sections <br />1163.11(b), 1163.12(h), and.1163.12(b). Chairman Gomersall called all interested pa.rties before the Board. The oath was <br />administered to D. King, attorney for Office Warehouse, Mr. Mongello, architect, <br />Councilman McKay, and Mrs. Blagg, who lives to the rear of this shopping center. <br />Mr. King stated that this request is based on a hardship due to the location of <br />the Office Warehouse store which is shielded from those travelling on Brookpark <br />Road by the structures in the front and the Procare shop. He believes that this <br />sign will make them more visible, and he is aware that this sign will have to be <br />removed in 1991. He presented photographs of the area showing the problem. <br />? Mr. Mongello explained that there willt be landscaping around the sign and it will <br />not be tall enough to obstruct the B.P. Procare sign. Councilman McKay agreed <br />that the sign is needed for identification, and he pointed out that the owner of <br />the center did install a fence along the entire property line. Mrs. Blagg, a <br />neighbor, contends that every time they get a variance the neighbors suffer. The <br />6 foot fence is actua.lly 62 feet, and is taller than her fence (she was told that <br />it would not be taller than her fence). She is complaining about the plaza, not <br />Office Warehouse. When they installed the fence, they removed some of her soil <br />. uncovering the cement footings of her fence and removed her railroad ties. The <br />workers told her that all of this would be rectified, but this was several months <br />ago and nothing has been done. She did talk to the City, but did not make a <br />formal complaint since she was assured that everything would be taken care of. <br />She does not believe that any more variances should be granted tmtil these thi.ngs <br />are rectified. Mr. King represents Office Warehouse and cannot speak for the <br />owner of the shopping center. She had other complaints about the dumpsters being <br />emptied too early in the morning by two different companies. The manager of the <br />shopping center asked that she call him instead of the police, but nothing ha.s <br />been done. When the previous variances were granted, the developer ha.d agreed to <br />have just one trash hauler in order to control the hours, but Building <br />Commissioner Conway did not believe tha.t was a condition of the variance, and he <br />advised that dumpsters cannot be emptied before 8:00 a.m. Mrs. Blagg maintained <br />that even though the dumpsters are now covered, the garbage blows into her yard <br />from tmder the fence. Mr. Mongello will contact the owner tomorrow and get this <br />taken care of. He pointed out that the owner has spent thousands of dollars on <br />the fence and the dLUnpsters. Mrs. Blagg gointed out that originally they ha.d <br />proposed a board on board fence, but this is not board on board and the bad side <br />of the fence faces her property.
