Marc's Funtime Pizza Palace 23333 Lorain Road. (Heard at this point)
Request for variance (1123.12). Request variance to use existing pole sign.
Violation of Ord. 90-125, Section 1163.22(a). Also request 45 square for variance
for total sign area. Violation or Ord. 90-125, Section 1163.11(c)
Chairman Gomersall called all interested parties before the Board. The oath was
administered to Mr. Schulman, attorney, Mr. Kuhns and Mre Saville, all
representing Marc's. The request is to use the existing Chuck E. Cheese pole
sign. Mr. Gomersall stated that the Board is concerned about granting new pole
signs, but it is somewhat different to use an existing pole sign. Mr. Schulmann
stated that they are just going to change the face of the sign, they will not be
adding to it at all. J. Maloney moved to grant the request of Marc's Funtime
Pizza Palace, 23333 Lorain Road for a variance to use existing pole sign and a 45
square foot variance for total.sign area, seconded by T. Restifo, and tmanimously
approved. Mr. Restifo advised them that all pole signs must be removed by January
1, 1998. Mr. Schulman stated that they were aware of that and since they on1.y
were tenants, they might not be there in 1998.. He further advised that they also
hold the lease on the Hobby's Etc., tmit and they support their request to use
this sign and stated that they both have the same problem since both units are
concealed by the adjacent buildings. Mr. Gomersall questioned who controlled, the
empty ground sign on the property for which Hobby's received a variance
previou.sly. Building Commission Conway stated that if the variance for Hobby's is
granted for the pole sign he would like the variance for the ground sign to be
rescinded, and he reminded the members that since Uoodwill was denied a variance
to use this pole sign, they could still use the ground signo Mr. Conway stated
that since Hobby's came in for a variance to use the ground sign, he assumed that
they have some control over it now. Law Director Gareau stated it appeared that
Goodwill would not let them use the sign. Mr. Conway requested that if Hobby's
gets the variance to use the pole there should be a condition that the ground
sign be removed. The members discussed why the use of the pole sign was denied
Goodwill and agreed that the variance was tied into the request for a wall sign
they wanted on Clague Road. F.
6. Please note: variance
granted on October 2, 1991 should be rescinded if this variance is grantedo
Chairman Gomersall called all interested parties before the Board. The oath was
administered to L. Costello and his son, W. Costello who explained that after
they got the variance to use the ground sign which they had planned to purchase,
they discovered that the electricity was not working and the sign was rusted out.
In the meantime Marc's leased.the property they gave them permission to use the
pole sign if they could get'a variance on the basis that both businesses appeal
to young people. The owner of the center was not sure who owned the ground sign.
Building Commissioner Conway stated that the owner of the property can be ordered
to remove the sign, and if he does not, he can have the sign removed and bill the
owner; but he would prefer that the tenants work with them so that this course is
not necessary. J. Maloney moved to grant the request of Hobby's Etc., for a
variance to place an insert on existing pole sign and a 14 square foot variance
for total sign area and also.with this motion we rescind the previously approved
4
