Request 10 foot variance for easternriost <br />landscape buffer and 1.5 foot variance for westernmost landscape buffer and 7 <br />foot variance for driveway to convert house from residential to office use. <br />Violation of Ord. 90-125, Section 1139.07 (table). Also request variance to <br />subdivide existing lot at the zone line into two lots, one commercial and one <br />residential. The comunercial lot will require a 12,300 square foot variance for <br />area and a 90 foot variance for frontage (frontage does not conform at present); <br />residential lot will conform. Violation of Ord. 90-125. Section 1139.06. <br />Subdivision of property was referred by Planning Comnission October 27, 1992. <br />Site plan review was referred by Planning Cormission November 24, 1992. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />ad,-ninistered to Dr. and Mrs. Natesan, Mr. Slezak, and 14r. and Mrs. D. Slezak, his <br />son and daughter-in-law, and A7r. and Mrs. Telegdy, the sellers. Building <br />Cornnissioner Conway e.xplained that it is now required to have a 10 foot side yard <br />buffer on commercial property, this lot will only have an 8.5 foot buffer on one <br />side, and no buffer an the other. There is no room for the required 18 foot drive <br />Dr. Natesan stated that the house would be converted to a professional office and <br />the existing garage will remain. Mr. Conway advised that the parking would <br />conform and there are plans to convert the lower level into some type of retail. <br />A variance is also being requested in order to split the lot since there is not <br />enough frontage or area for the General Retail portion in front, the rear portion <br />is residential and does conform. Law Director Gareau stated that there is a <br />benefit in having the lot follow the zoning line, since there have been court <br />decision allowing retail use on a split zoned lot. Mr. Slezak stated that he has <br />invested quite a bit of money in remodeling the house, and he would like a <br />privacy fence which would start about 20 feet from the road. Mr. Gareau stated <br />that there was a problem installing a privacy fence in a comnercial district <br />since that house could always be sold for a commercial use then there would be <br />ttao cor,mercial properties divided by a privacy fence. Mr. Slezak stated that Dr. <br />Natesan had agreed to put up a fence, if they did not object to the requests. The <br />members agreed not to get involved in a private agreement. Mr. Conway stated that <br />this issue could be addressed by the Planning Commission. Mr. Gareau stated that <br />they are askin,g for a privacy fence on comnercial property which really does not <br />make sense. Nir. Slezak pointed out that Mr. Telegdy ha,d pu_t pipes in his yard to <br />keep his former tenants .from drivirg over his yard and he does not ivant the same <br />problem. 14r. Grace believed that thi.s renovation would have a positive effect on <br />the Slezak property, and suggested a low wood guardrail similar to that which was <br />7
