Request variance to iristall 6 foot fence in side
setback. Violation of Ord. 90-125, Section 1135.06(b).
Chairman Gomersall called a11 interested parties before the Board. The oath was
administered to Mr. and Mrs. Bleiler, who explained that the vacant lot behind them
is being used as a playground for the neighborhood children. Since they have
extensive landscaping in the rear, this fence «ill help keep balls from going into
their yard and will also give them more privacy. It was clarified that the 6 foot
fence would taper down from 6 feet to 30 inches at the sides. Building Commissioner
Conway pointed out that this lot will probably be developed at some time and the
gaxage could be placed adjacent to the fence which could cause a visibility problem
suggested one entire section of the fence should only be 3 feet high. The members
suggested limiting the variance for three years, and then if a house is built on
that property within that time, the variance can be re-reviewed. R. Gomersall moved
to grant a variance to Jim and Emily Bleiler, 5502 Quail Run, to install a 6 foot
fence in the side set back not to exceed three years, seconded by B. The oath was
administered to Mr. Motsis who presented a revised plan which showed the deck in a
slightly different position. The position of the deck would not matter as much as
how close the deck will be to the addition. Mr. Motsis explained that he should have
about 5 feet between the addition and the deck, and he also questioned if he needed
a rear entrance. Building Commissioner stated that, unless he is eliminating the
existing back door, another exit would not be required. The members have no problem
with the request. B. Grace moved to grant the request for a 14.3 foot rear yard
variance to construct an addition and also a 84 square foot variance for over the
permitted 20% of the required area of the rear yard, for Nicholas Motsis, 25142 Doe
Drive, seconded by R.
