Mr. <br />Thomas stated that he was pleased with the developer's efforts to comply with the <br />Commission's requests. The members agreed that alternate scheme 3 was preferable. <br />It was clarified that it was no longer possible for cars to drive over the <br />sidewalk to get onto Hickory Lane because there was a 2 foot high timber buffer <br />and also that the fence w:L11 be extended 50 feet down the side line. Building <br />Commissioner Conway advised that the sign is a little too high and the location <br />does not conform to code and would either require a variance or ha,ve to be <br />modified. He further stated that variances will also be required for the front <br />landscape buffer on part of the front and side bu.ffer area but the new parking <br />area buffer will conformm He understood that the Corrnnission preferred that the <br />front landscaping be smaller (7 feet) in order to increase the landscaping in the <br />back. Councilman Nashar was concerned about the lightinge It was clarified that <br />the rear pole light was presently directed to shi.ne to the south (away from the <br />residences) and the three 150 spot lights were to be changed to a shadow box type <br />of fixture. Assistant Law Director Dubelko advised that this proposal would not <br />have to return to the Comission after the Board of Zoning Appeals if inembers did <br />not think it was necessary. J. Thomas moved to approve the site plan and modified <br />landscaping on the alternai:e scheme three plan of Nightfall Night Club at 30850 <br />Lorain Road incorporating all the suggestions of the Architectural Review Board, <br />Plarming Commission, Safety, Building, and other departments who have reviewed <br />the plan. We Understand that a performance bond was to be duly placed with the <br />city to guarantee compliance with the plan, and also this approval is conditional <br />upon a 13 foot variance far the front setback with the recomendation that the <br />B.Z.A. approve that variance noting that the developer has complied with all the <br />plarLn;ng Commission and A.R.B. recommendations. The Commission has no problem <br />with them using gravel until May 15th as recommended by the Building <br />Commissioner. If this variance is approved by the B.Z.A. the proposal does not <br />have to return to the Commission, it can go directly to the B.Z.D. committee, <br />seconded by L. Orlowski, and unanimously approved. During the motion Mr. Orlowski <br />complemented the developers on their compliance with the recommendations of the <br />Commission and stated that this was a good design. <br />2e Spermuli Marathon, 28700 Lorain Road. <br />Proposal to construct canopy over plunp island. <br />Heard by Board of Zoning Appeals December 2, 1992. <br />Mr. Spermuli, owner, and Mr. D'Aganese, contractor, presented plans for the <br />canopy. Building Commissioner Conway advised that the Planning Commissian had not <br />ma,de any approvals at the November meting, the proposal was mrely forwarded to <br />the Board of Zoning Appeals who in turn had granted a variance. After some <br />discussion it. was decided this proposal should be sent to the Architectural Board <br />for suggestions on landscaping. It was clarified that the canopy would be the <br />same as the one at the station an Lorain Road and Butternut Ridge. Mr. Spermuli <br />presented a sketch of some proposed landscaping, but it showed landscaping around <br />the Marathon sign, not around the Goodyear sign as previously suggested by Mr. <br />Orlowski. Mr. Tallon ques-tioned the height of the canopy in comparisoi-r-to the <br />height of the building since he was concerned that the lighting under the canopy <br />would shine onto the adjacent residential properties. Mr. D'Aganese maintained <br />that the light shinning down from the canopy would not go beyond the rear of the <br />buildingo L. Orlowski moved to approve the Spermuli proposal to construct a <br />canopy over the pump island^ 28700 Lorain Road, contingent upon the Architectural <br />Review Board's approval of the landscaping around the Goodyear sign on the <br />2
