Mr. Newberry stated that without widening 14ill it would be impossible. The <br />minutes of October 13th were checked and it had been stated that the Mill Road <br />exit would be used for enpty trucks. Mr. Newberry stated that this was never the <br />intent, and but i-t might have been misinterpreted during the discussion. It was <br />clarified that what appeared to be a 9 foot lane on the plans, was not the i%Ti.dth <br />of a.lane. Mr. Popotto had many eoncerns about the traffic and believed that no <br />matter how this proposal is resolved there will be problems and he will be the <br />loser. Councilman Lind responded to the previotzs speaker (?Kr. Trapp) -stating <br />that, whether or not he as a private individual, was desirous of Wal-Mart going <br />in at this location, he is charged in the city charter to analyze the viability <br />of a development and is required to be impartial. When a completed proposal comes <br />before city council, he will have to put his personal feelings aside and make a <br />decision based on what he feels is the best for the city. Mr. Deichmann advised <br />that there is an attemDt to restrict truak traffic on all of Dover Center. but he <br />does not lmow how far north trucks are permitted at present, and no se.rii-truck <br />traffic is permitted on Porter Roado Mr. Thomas noted that no truck traffic is <br />permi_tted at present on SLearns Road at I-480, and since all truck traffic must <br />use Great Northern Boulevard from I-480, he questioned what effect these trucks <br />would have on that traffic. It was determined that there would only be 8 trucks a <br />day which would have little impact. Mr. Thomas stated that if there was an effort <br />to eliminate truck traffic on Dover Center would it not be in the best interest <br />of the city to eliminate all truek ingress or egress on Dover Center or Mill <br />Road. Mr. Deichmann agreed it would. It was also clarified that there was some <br />construction when the traffic study was done, and Mr. Herbster verified that the <br />road was still closed at the time of the last meeting, so the report would be <br />incorrect. The Engineering Department will check on this and make a report to the <br />Commission. Mr. Thomas advised the developers that the Commission could vote on <br />the proposal as it is submittecl, but he did not think tha.t the developers would <br />want this, and also thi5 is .not a complete proposal, there are no detailed <br />landscape plans or detailed lighting plan s which are required to have been <br />included but could be submitted later. He advised that Section 1126.04 of the <br />Zoning Codes establishes the right of the Plaruiing Commission to alter a proposal <br />based on the determination that the proposal will have a significant adverse <br />impact upon either residential, commercial, or other neighbors, vehicular or <br />pedestrian safety or aesthetically upon the comrmuni ty, and we are permitted to <br />make such changes to a submitted plan to aneliorate the adverse impact to the <br />fullest extent practicable. J. Thoma,s moved that, based on the ordinance tha,t was <br />just read and which is to be part of the motion, the Commission wi11 require the <br />following changes to the Wal-Mart development: that access an Mill Road be <br />eliminated; that access on Dover Road be eliminated; that the main access to <br />Wal-Tiart be established on Lorain Road in proximity and opposite the current bus <br />depot and driveway to the city, and that a second access, possibly the old <br />Sherwin Williams access, be used as a right turn in and right turn exit only; <br />that a complete detailed landscaping and lighting plan as well as a signage plan <br />be provided at the time the proposal is revised; and that the City provide a cost <br />of signalization for the main access on Lorai.n and provide direction to the <br />developer in order to plan the opposition of the main access to the municipal <br />driveway along Lorain Roaci with appropriate traffic control. Also that the plan <br />as revised be subriitted to the Safety, Engineering, and Building Departments for <br />their input. This motion is to include 13 points that were in the original <br />motion, including the request for the re-configuration on this lot of the <br />building or the moving of the truck dock to a different position on this lot. <br />That a new plan be provided incorporating a buffer surrounding the development an <br />the sides that border residential neighborhoods that should be composed of a <br />mound with a minimum height, not ineluding trees and shrubbery, of 8 to 10 feet <br />6
