Orlowski <br />moved to approve Great Northern Dodge, 26100 Lorain Road, proposal to alter <br />facade of existing building, install canopy on side entrance, and construct <br />display pads in front setback incorporating all recommendations of the Planning <br />Comi.ssion and Architectural Review Board and all variances of the Board of <br />Zoning Appeals and the Commissian requests that Mr. Fee, the architect, contact <br />Mr. Sohn of the Architectural Review Board and present a muted color or several <br />muted colors of the bright red that he has presented tonight to see if there is a <br />more muted red that would be available-, and after Mr. Sohn has reviewed these <br />colors he can present his findings to the B.Z.D. Committee of Council, seconded <br />by B. Gorrise Roll call an wtion: Orlowski, Gorris, 0'Rourke, and Skoulis, yes. <br />Mr. Thomas, no. Motion carried. Mr. Thnmas explained that his no vote was because <br />of the display pods. He would like the B.Z.D. and the B.Z.A. to be aware of why <br />he voted no. <br />N. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />1) Cleveland Electric Illuminating Company Assembly and Lot Split Plat, <br />Resubmission. <br />The proposal is to combine and re=subdivide all or part of Permanent Parcel Nos. <br />237-5-1, 237-5-3, 237-5-23 and 237-7-18 into two (2) parcels. <br />Heard by Board of Zoning Appeals June 3, 1993. <br />Mr. Buerskin, represeritative of the Illtuninating Company, advised that Assistant <br />Law Director Dubelko and the attorney for United Survey have agreed on a <br />covenant. A copy of the agreement had been presented to the clerk and to <br />Councilwoman Saringer who was present. Councilwoman Saringer advised that at the <br />last B.Z.D. meeting there were questions so no action was taken at that time. Mr. <br />Dubelko, who had just arrived, advised that he had prepared the covenant and that <br />it does accomplish what the Planning Conunission had requested. Mr. Gorris <br />explained to the audience that this lot split and assembly does contain some <br />split zoned larxi arnd the covenants were included to maintain the existing zoning. <br />Councilwoman Saringer stated t-hat the meinbers were concerned that the same thing <br />might happen as happened at the property at Columbia and Lorain, but Mr. Dubelko <br />had assured her that was the reason of the restrictive covenant. This will be <br />discussed at the next BZD cammittee meeting. B. Gorris moved to combine and <br />resubdivide all or part of Permanent Parcel Nos. 237-5-1, 237-5-3, 237-5-23 and <br />237-7-18 into two (2) parcels incorporating the restrictive covenants agreements <br />as agreed to by the City of North Olmsted, the Cleveland Electric Illlmiinating <br />Company, and United 5urvey, seconded by J. Thoma.s, and unanimously approved. <br />2) Schmidt and Zernechel Lot Split and Assembly Pl-at. <br />The proposal is to split permanent parcel no. 231-28°4 located on the north side: <br />of Lorain Road between Gessner and Walter Roads, into two (2) sections so that <br />the rear section can be joined to permanent parcel no. 231-28-3 (Adon Equipment) <br />which abuts on the east. Zoraing is split on both proposed sublots, being Retail <br />Business, General on the south whieh fronts on Lorain Road, and "C" Residence, <br />single in the rear (north) area (minor section). Proposed Sublot B(with resident <br />dwelling) does not conform to the Zoning Code.Requirements for either frontage or <br />area. <br />Chairman Gorris read the request. Assistant Law Director Dubelko advised that <br />the restrictive covenant has been prepared and sent to Councilwoman Saringer and <br />the developer. Mr. Thoma.s advised that the Commission was concerned about <br />2
