Assistant Law Director Dubelko stated that this covenant would also <br />provided for retaining the residential portion as green area. The members.had no <br />problem with the requests. J. TYlomas moved to approve the proposal to split <br />permanent pareel no. 231-28-4.into two (2) sections so that the rear section can <br />be joined to permanent parcel no. 231-28-3 which is Adon Eqnipment and <br />incorporate all the recomendations of. this Conunission including the restrictive <br />covenant that accompanies the deed to the parcel, seconded by K. 0'Rourke, and <br />unanimously approved. <br />III, BUILDING DEPARTMENT REQUESTS .( Restuned) : <br />TO BE HEARD AT 8:30 P.M. <br />Since the developer was just arriving, Chairman Gorris called a short recess. <br />3) Wal-Mart Store, 27254 Lorain Road (former Sherwin Williams site including part of <br />Cross Roads.Dealership and property at 27423 Mill Road). <br />Proposal to construct building. <br />Tabled at meeting of January 18, 1993, <br />Chairman Gorris explained the responsibilities and authority of the Commission, <br />noting that whether the Cor.IInission rejeets or accepts this proposal, it will go <br />on to Council who must give the final approval. The Planning Commission only <br />reviews for conformance to the Zoning Codes, safety concerns on the.-parcel <br />itself, but not the safety concerns of the intersections. In response to a <br />question frm the audience, Assistant-Law Director Dubelko reiterated that it-is <br />the Commission's purview to enforce the Zoning Code which relates to the size of <br />buildings, the location of buildings on lots, access points fran lots onto public <br />streets. It is the city's primary re5ponsibility to handle the condition of ,the <br />streets: size, intersections, smootiz traffic flow, etc. Mr. Gorris advised-the <br />audience that after Wal-Mart's preserttation and the Commission's discussion of <br />the presentation, the audience wi:ll bee asked to comnent. NIr. Newberry, consulting <br />engineer representing Wal-Mart, introduced Mr.. Bingham, real estate manager for <br />Wal-Mart for Ohio and Michigan; S. Lane, civil engineer for Wal-Mart; D. King, <br />manager of the Wal-Mart store in Elyria; and D. Lepisto, traffic consultant. At <br />Mr. Thomas' request he introduced Mr. Gavin and Mr.. Coyne, attorneys for Shertain <br />TnTilliams. Mr. Newberry went over the items requested at the meeting of July 13th. <br />The truck docks have been rotated to the south face of the building, and the <br />truck route has been changed so there will be no encroachment west of the <br />building (adjacent to residential property) either at this time or in the event <br />the expansion is built, a1l trucks saill approach the dock from the east. The <br />landscaping mound has been extended around the north end of the site to block the <br />view of headlights from Mill Roade Landscaping and a sidewalk have been included <br />on the property which fronts on Dover Center Road. They have met with McDonald's <br />and have iricluded a preliminary sketch which shows access from the east across <br />the north side of McDonald's exiting onto the west (McDonald's is considering <br />changing their drive across the front whieh is merely a suggestion at this time). <br />The complete sign program has been reviewed by the Building Department and they <br />have received a letter advising of the variances needed for the signs. The side <br />cut of the landscape mound is shown on the plan, this mound will be 8 feEt high <br />and will be located in the 50 foot rear set back, but it will be far enough away <br />fran the property line to install a drainage ditch or swale between the property <br />line and the beginning of the mound to divert water coming from the west; this <br />mound will start at the existing grade, rise 8 feet, and end at that grade. In <br />referenee to raising the floor elevation of the building, this has not been <br />decided as yet and is dependent on rhe drainage plan. As far -as the cross <br />accesses are caneerned, the MeDonald's plan shows that this could be done with no <br />violations, however these plans are not final, and are merely conceptual. He <br />3
