1_?. <br />Mr. Freeh, contractor, explained that the owners will be renovating the facade <br />and adding a new entrance on the east end of the building to accommodate the <br />service area, the interior is being renovated at present, and an addition to the <br />rear for a tool storage area and a door will be constructed. He clarified that <br />the door is for the service area. The plans were explained to neighbors, Mrs. <br />Duffy and Mrs. LaRosa, who were concerned about then adding any additional lights <br />since the lights on the site now axe a problem. The members discussed the plans <br />with the neighbors and individually. Assistant City Engineer McDermott advised <br />that some of these parcels were assembled. Mr. Gor_ris questioned if there was <br />sufficient parking with the additions since no parking is shown. Mr. Gorris <br />stated that the Commission could not act on this without seeing a parking plan. <br />The Conmnission originally asked for a.landscape buffer on Lorain Road which is <br />now in court; however, the neighbors questioned why there could not be some <br />landscaping an the side street where the fence is almost to the sidewalk. It was <br />decided that this should be tabled Until a parking plan is presented and Chairman <br />Gorris noted that if they make a wrong move this evening, it could jeopardize <br />their position in court. Assistant Law Director Dubelko advised that whenever a <br />developer adds to a building and incrEases the floor area the developer is <br />required to bring parking up to code and the members would like to see plans with <br />parking, lighting, and landscaping. Mr. McDermott will bring in the assembly <br />plats at the next meeting since there is some doubt if the last parcel was ever <br />assembled. L. Orlowski moved to table the Halleen Chevrolet Inc., 27932 Lorain <br />Road, proposal to renovate building and eonstruct two small additions, until the <br />Comnission can receive proper landscaping and parking schemes that would identify <br />where everything is on these lots and showing the asseMblies of all parcels, <br />seconded by B. Gorris, and unanimously approved. <br />Chairman Gorris advised that there would be a 5 minute recess prior to heaxing <br />the next item. At this point Mr. Thomas asked to be heard before the recess and <br />before the discussion of the Ice Cream Parlor since he would be excusing himself <br />fran tha.t discussion. He advised that before there was any discussion of the Iee <br />Cream Parlor he had called the Assistant Law Director and ha.d advised him that <br />his family did own property on either side of this development, but that he had <br />no financial interest in it. Mr. Dubelko had indicated that there would not be a <br />conflict. At the first meeting on.this project, he advised the Commission and Phr. <br />Benik of the situation, and it did not seem that Mr. Benik had any difficulty <br />with this; however, at the last meeting when Mr. Benik did not get <br />recommendations for all of the variances that he requested, he implied that he <br />did have a problem with Mr. Thomas's participation. Those discussions were <br />preliminary, but tonight's discussion would be on the final plans, and Mr. Thomas <br />advised that he will abstain from this discussion, and any future discussion in <br />order to create a better comfort level for the Conuni.ssion and for Mr. Benik. <br />Chainnan Gorris reconvened the meeting. <br />Ice Cream Parlor/Restaurant, 27045 Lorain Road. . <br />Proposal to construct new building (existing building will be demolished). <br />Heard by the Board of Zoning Appeals on August 4, 1993. <br />Mr. Agnew, architect, presented the plans. At this point, Mr. Gorris advised Mr. <br />Benik that at the last meeting which Mr. Benik attended, Mr. Benik had <br />interrupted the meeting and Mr. Gorris had to call the police. Mr. Benik left <br />before the police arrived; however, should Mrm Benik choose that behavior either <br />tonight, or in the future at any meeting that Mr. Gori-is chairs, he will call the <br />police and if Mr. Benik leaves, he, personally, will mvear out a warrant for Mr. <br />Benik's arrest. Mr. Ab ew stated that it had previously been decided that he <br />would be making the presentation. He advised that the proposal is to construct <br />6
