Mr. Gorris advised that he had not been privy <br />to this. Mayor Boyle responded that none of the Planning Commission members had tieen privy to this, they had only shared with the Commission what had been said <br />this evening to everyone. Negotiations are still going on. r2r. Strnad asked <br />another question which was not audible. Mr. Thomas responded that this is the <br />first time anyone has heard of this, and this is what the city officials are <br />working on and they cannot give an answer unless the negotiations are <br />satisfactory to the people who own whatever property is involved. Mr. Strnad <br />believed that this is only a 2ioeek or 2 month pacifier. r1r. Sokol, a resident, <br />asked if this question is to be delayed until after the elections. Ma.yor Boyle <br />stated that it would not necessarily be delayed that long, he would hope to <br />resolve this in the next few weeks. Mr. Sokol noted a few weeks would be <br />November. Law Director Gareau stated that the negotiations that they have been <br />involved in regarding this matter, are not to delay this matter so that an answer <br />cannot come aut before the election, they are earnest negotiations, very <br />difficult negotiations, round the clock negotiations with the best interest of <br />the residents of this city in mind., The administration recognizes the problems <br />with this proposed location and v-ith that thought in mind, they have done <br />everything in their power to resolve that problem with the co-operation of Wal- <br />Mart, but they cannot say anymore about.what site, or sites, may be preferable, <br />but the idea is not to negotiate with the thought that Wal-Mart will eventua.lly <br />be built an this site. Mayor Boyle reiterated Mr. Newberry's statement that "In <br />order to fully explore other sites..." Ghairman Gorris asked Mr. Herbster, one of the residents leading the opposition to this site, to speak. Mr. Herbster thanked <br />everyone who showed up and who had put effort into this campaign. He stated that <br />if Wal-Mart was not interested in moving the site, he did not believe that they <br />would ask to have it postponed. The residents must continue their diligence. He <br />also thanked Mrs. Cindy Buechler who was a major contributor to the cause. Mrs. <br />Buechler stated that this is a small vietory and possibly they coulci work with <br />the Mayor to see what other incentives could be offered to further these <br />negotiations. Mr. Strnad asked Mr. Newberry the rnamber of feasible alternatives <br />that have been considered. Mr. Newberry stated that there were at least one and <br />less than 10 sites both within and outside of North Olmsted which they have been <br />actively pursuing. Mr. Benka, a resident, asked if there taere not enough stores <br />in North Olmsted, and noted that there were many stores empty, even in the mall. <br />He wanted tidal-Mart to stay out of North Olm.sted and out of the county. Mr. Strnad <br />stated that he ha:d lived in the city 6 months and he was moving. Mr. Sokol <br />questioned the test results fram the E.P.A. samplings taken fron the site. City <br />Engineer Deichmann advised that the E.P.A. had found minimal contamination in the <br />area and had ruled that it was found in such small amounts that it was not a <br />hazardous waste and could be disposed of in a regular sanitary landfill. These <br />concentrations were found only at the surface, nothing was found below two feet. <br />Mr. Sokol was given copies of the report, and he stated- that the toluene <br />mentioned was a suspected carcinogen. J. Thomas moved to table the Wal-Mart <br />development until Wal-Mart signals that they are prepared to come before the <br />Cor.miission within a reasonable amount of titne to either present new plans or <br />withdraw the current plan and that the Building Department must be given two week <br />notification. Mayor Boyle interceded at this time, and suggested that a specific <br />date such as the second meeting in November be stipulated in the motion. Mr. <br />Newberry stated that this might be an appropriate time. Mayor Boyle requested <br />that the motion state no later than the second meeting in November. Mr. Thomas <br />amended his motion to state that the Wal-Mart proposal w-i]1 be deferred until the <br />second meeting in November or sooner if people in the cormmuni.ty can be _ <br />2
