, <br />. <br />Chairman Gomersall called all interested parties before the board. The oath was <br />adm.inistered to Michael Stergo, representing his uncle. Mr. Gomersall stated that <br />the request was to reconstruct a residence in a Limited Industrial area where <br />residences are prohibited. Mr. Stergo stated that the house is in need of repair <br />the roof is caving in, the walls have to be repaired and these repairs will improve <br />the.?neighborhood. Mr. Gomersall stated that this would perpetuate a residential use <br />which is what the city does not want to do. Building Commissioner Conway advised <br />that the intent of the code is to eliminate residential uses in this district. They <br />are not only repairing the house, but are expanding it. During the Plann;ng <br />Commission's discussion of the Ma,ster Plan there had been no mention of rezoninro <br />this area to residential. Mr. Stergo noted that his uncle had purchased this <br />property several weeks ago. Mr. Conway advised that a letter was sent to Mr. Stergo <br />on December 11, 1992 advising him tha.t variances would be needed. Mr. Gomersall <br />believed that this would be in opposition to what the Planning Corrunission intended <br />for this area. B. Gomersall moved to grant the requests of Tom Stergo, 31410 Lorain <br />Road for a variance to reconstruct residence in a Limited Industrial Area; a 56 <br />front setback -variance; a 17 foot side yard variance; a 145 variance for m-ininn,m <br />lot width and a special permit to expand, alter, and restore a- nonconforming <br />building, seconded by W. Purper. Roll call on motion: Gomersall, Purper, and <br />Maloney, no. Motion failed..to pass. Variances and special permit denied. <br />2. Gerald M. StrinRer. Permanent Parcel 237-30-06, located north of 5783 Columbia Rd. <br />Request for variance (1123.12). Request 25 foot front setback variance to <br />construct new dwelling. Violation of Ord. 90-125, Section 1135.06(a). <br />Variance previously granted on November 18, 1990 has expired. <br />Cha.irman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. Stringer who explained that they ha.d received a variance in <br />1990, but did not go forward with the construction, now they are ready to build. <br />The members had no problem with the request. B. Gomersall moved to grant the <br />request of Gerald M. Stringer, Permanent Parcel 237-30-06, located north of 5783 <br />Colunbia Road, for a 25 foot front setback variance to construct a new dwelling, <br />seconded by J. Maloney, and unanimously approved. Variance granted. <br />3. Joni Elias, 5476 Berkshire.Drive. <br />Request for variance (1123.12). Request 6 foot 6 inch rear yard variance to <br />install roof and screens on existing deck. Violation of Ord. 90-125, Section <br />1135.08(a). Also request Special permit to add to non-conforming dwelling. Special <br />permit required Ord. 90-125, Section 1165.02(b). <br />Chairman Gomersall ca11Ed all interested parties before the Board. The oath was <br />administered to Mr. Haag, contractor. The members had no objection to the request. <br />W. Purper moved to grant the request of Joni Elias, 5476 Berkshire Drive for a 6 <br />foot, 6 inch rear yard variance to install roof and screens on existing deck, and <br />also a special permit to ad.d to nonconforming dwelling, seconded J. Maloney, and <br />unanimously approved. Variance ancl special perniit granted. <br />4. Long John Silvers, 25482 Lorain Road. <br />Request for variance (1123.12). Request 56 square foot variance for total sign <br />area allowed; request 75.5 square foot variance for sign area allowed for a <br />business use; request variance to add to and keep a prohibited existing pole sign <br />and variance to keep changeable copy portion of that sign. Also request variance <br />for 3 directional signs: 1 square foot size variance 2 foot height variances and 8 <br />foot variance for setback from right. of way. Violations of Ord. 90-125, Sections <br />1163.11(b) and (a); 1163.22 (a); 1163.03(d) and 1163.12(e). <br />2
