The oath was <br />administered to Mr. Schmidt and Mr. Kaserman, awners of Adon, who explained the <br />proposal and pointed out where the residential portion was located which cannot be <br />rezoned. Mr. Gomersall read the Planning Conunission. minutes and had no real <br />problems with this proposal as long as the restrictive covenants are included. R. <br />Gomersall moved to grant the Schmidt and Zernechel Lot Split and Assembly Plat, <br />23904 Lorain Road, their request for 23,992 square foot'variance to split off rear <br />-of parcel 232-28-4 and add it to 231-28-3 (Adon Equipment), with the provision <br />th.at the restrictive covenant as dictated by the Planning Commission in the <br />mi.nutes of June 22,1993 be included, seconded by B. Grace, and unanimously <br />approved. Variance granted. 6. David D. and Lynn M. Huspaska, 6632 MaplEhurst Road. <br />Request for variance (1123.12). Request variance to construct 6 foot.solid fence <br />in side yard of corner lot to be located in front of the required building <br />setback of the abutting lot on the side street. Violation of Ord. 90-125, Section <br />1135.02(f)(2). <br />Chairman Gomersall ealled all interested parties before the board. The oath was <br />administered to Mr. & Mrs. Huspaska. The members do not want a 6 foot high fence. <br />1`he fence wi.ll be 9 foot off the sidewalk and will be board on board. Mr. <br />Huspaska agreed to change the height to S foot and advised that the chain link <br />portion near the garage was to enclose the trash cans. Mrs. Botson, a neighbor <br />across the street was sworn in at this time. Mr. Huspaska was considering cutting <br />off the corner of the fence at the drive to help visibility and advised that he <br />checked the visibility fran the drive before submitting the plans. Chief Building <br />Tnspector Sanker advised tha.t the Building Department had to determine if there <br />would be sufficient visibility and thought taking the corner off would help. Mrs. <br />Botson prefers the 5 foot fence. Mr. Maloney moved to grant David D. and Lynn M. <br />Huspaska, 6632 Maplehurst Road,- their request to construct a 5 foot shadowbox <br />fence in side yard of corner lot to be loeated in front of the required building <br />setback of the abutting lot on the side street, seconded by B. Grace, and <br />unanimously approved. Variance granted. <br />7. Bi11 Metzger, 23117 Marion Rd. <br />Request for varianee (1123.12). Request 10 foot front setback variance to <br />construct roof over existing poreh. Violation of Ord. 90-125, Section 1135.06(a). <br />Also request special permit to add to a non-conforming dwelling. Special permit <br />required Ord. 90-125, Section 1165.02(b)(1). <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. Metzgerm Mr. Gomersall noted that this had already been <br />constructed. Mr. Metzger stated he started before he lnew he needed a permit.and <br />after he applied for the permit, he was told he needed a variance. The meinbers <br />had no problem with the request. T. Koberna moved to grant Bill Metzger, 23117 <br />Marion Road, his request for a 10 foot front setback variance to construct roof <br />over existing porch, and also to grant a special permit to add to a non- <br />conforming dwelling, seconded by R. Gomersall, and unanimously approved. <br />Variances granted. <br />3
