5. Mark and Yvonne Mazzone, 25341 Fawn Drive. Request for variance (1123.12). Request 25 foot.variance to extend existing S foot fence to rear of house on corner lot which will be in the front setback of adjacent house (facing side street). Violation of Ord. 90-125, Section 1135.02(f-2). Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. and Mrs. Mazzone, and a neighbor, Mr. Mazanec, who lives in the adjoining property, and advised that he is opposed to a fence adjacent to his front yard. Another neighbor wrote a letter complaining about the condition of the existing fence, but had no objection to the variance for the extension. Mr. Mazzone advised that they were going to put in an entirely new fence and would not be adding to the existing. Mr. Grace pointed out that when he stepped off the fence he determined that the fence would not impede Mr. Mazanec's view since he would not be able to see the fence from his house. Mrs. Ma.zzone stated that Mr. Mazanec's garage was next to the fence. It was clarified that this would be a 5 foot fence. Mra Mazzone noted that they need a fence for their child who plays in the yard. Mr. Gomersall stated that he would object if this was not adjacent to Mr. Ma.zanec's garage. It was again stated that they would be replacing the entire fencee B. Grace moved to grant the variance for Mark and Yvonne Mazzone, 25341 Fawn Drive, for a 25 foot variance to extend existing 5 foot fence to rear of house on corner lot which will be in tne front setback of the adjacent house, seconded by R. Gomersall, and imanimously approved. Variance granted. Mr. Mazanec objected that this would make his front yard look like a back yard. 6. GTE Nobilnet, Inc. 26791 Brookpark Rd. Ect. Request for variance (1123.12). Request variance to mount air balloon on roof. Violation of Ord. 90-125, Section 1163°04(g). Previous variance granted on July 7, 1993. Chairman Gomersall called all interested parties before the board. The oath was administered to Ms. Morgan, representing Mobilnet, who advised that they had installed a balloon the first time, but it had been delivered late and was only up a few days. The first balloon was only 12 feet'high and was not too visible over the parapet, this one will be larger. She does not believe that they will be asking for this again and clarified that the balloon would be up from October 18 through the 31st. R. Gomersall moved to grant the request for a variance to mount air balloon on the roof for G.T.E. Mobilnet, Inc., 26791 Brookpark Road Ext. for a period of October 18th through October 31st, seconded by J. Maloney, and unanimously approved. Variance granted. 7. Rally's Restaurant, 27208 Lorain Road. REVISED REQUEST Request for variarice (1123.12). Request variance to have prohibited pole sign with prohibited changeable copy sign attached. Violation of Ord. 90-125, Sections 1163.22(a) and 1163.08(a). Alternate pole sign requests are submitted for consideration: one is for a 116.4 square foot pole sign (including reader board) which would require a 87.9 square foot variance for total sign area; the alternate request is for a 50.18 square foot sign (including reader board) which would require a 21.68 square foot variance for sign area. Violation of Ord. 90-125, Section 1163.11(a). Also request location variance for four directional signs which encroach in the 10 foot setback from the right of way line and one of these also encroaches on the 15 foot side property line setback on Dover Center Road. Violation of Ord. 90-125; Section 1163.12(e). PLEASE NOTE: First sign is 25 foot 6 Ynches tall, second sign is 23 feet, 9 inches. Mac;Tmun height for a ground and pylon sign shall be five feet and eight feet respectively Section 1163.12(b). 3
