Violation of Ord. <br />1165.02(d)1. <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. Novak and the builder, Mr. Sperlia Mr. Gomersall clarified <br />that this would be an elevated screened-in porch off of the bedroom. The members <br />had no objections to the request. R. Gomersall moved tb grant to Mr. Bill Novak, <br />26839 Sudbury Drive his request for an 8 foot rear yard variance to construct a <br />screened in porch on rear of house, also to grant a special permit to add to a <br />non-conforming dwelling, seconded by W. Purper, and una.nimously approved. <br />Variance and special perriit granted. <br />'S. John M. Matheny, 5656 Canterbury.Road. <br />Request for variance (1123.12). Request Special permit to rebuild a portion of <br />and add to a non-conforming dwelling (3 foot side yard and 20 foot rear yard). <br />Special permit required Ord. 90-125, Section 1165.02(b)(1). Also request 226 <br />square foot variance for garage area to construct an attached garage (existing <br />400 square foot garage an prenises)o ' <br />Variance granted on 7/2/86 to add to living area. <br />Chairman Gomersall called all..interested parties before the boardo The oath was <br />administered to Mr. Matheny. It was clarified that he would have to tear down a <br />20 by 20 foot section of the house and rebuild it and add an attached garage. It <br />was explained that there was a 400 faot garage on the property in the rear which <br />he plans to keep it for storage. Eventually he would like to remove the patio and <br />convert the garage to a family room but this will be in the future. Building <br />Commissioner Conway stated that if the old garage does become part of the house, <br />it N%T-ill not ha.ve a 50 foot rear yard. The house backs up to the new View Point <br />development. J. Maloney moved to grant to Mr. Matheny a special permit to rebuild <br />a portion of and add to a non-conforming dwelling (3 foot side yard and 20 foot <br />rear yard).. Also to grant a request for a 226 square foot variance for ga.rage <br />area to construct an attached garage (existing 400 square foot garage on <br />premises). Originally a variance was granted on July 2, 1986 to add to living <br />area. In addition the garage must have a fire wall rating and it is to be noted <br />that in the future the patio will be taken down and the old garage area will be <br />converted into living area,. seconded by T. Koberna,. and unani.mously approved. <br />Special permit and variances granted. <br />6. Mark J. Obral, 4390 Birch Circle. <br />Request for variance (1123.12). Request variance to have an in-ground pool with <br />a fence less than 6 feet high (5 foot on one side 4 and 5 foot on other). <br />Violation of Ord. 90-125, Section 1135.02(i). <br />Chairman Gomersall called all interested parties before the board. The oath wa5 <br />administered to Mr. Dill, a nEighbor, and Mr. and Mrs. Obral, who explained that <br />he intended to put another 4 foot fence inside the yard so that his daughter <br />cannot get into the pool area. Since they live on a cul-de-sac they have very <br />little traffic. Mr. Gomersall is coneerned about the 4 foot fence. Mr. Obral <br />believed that people would have to enter his back yard from Columbia Road and go <br />through other back yards to get to the 4 foot fence. Mr. Gomersall stated that <br />children could get in from the front. Mrs. Obral noted that they had two dogs. <br />Mr. Obral could rim a portion of a 5 foot fence to Mr< Dill's house if he had no <br />objection whieh would.block entrance to the yard, he also pointed out that the 5 <br />foot fence was actually 5 foot 6 inches. The members object to the 4 foot fence. <br />Mr. Obral asked to amend the variance to have 5 foot fence which would mean <br />3
