The members agreed to a 5 foot fenee which wouid need a 1 foot <br />variance. J. Maloney move to grarnt to Mark J. Obral, 4390 Birch Circle a variance <br />to ha.ve an in-ground pool with afe7ice less than 6 feet high, it will be a one <br />foot variance on the side lots of his property and the fence will extend toward <br />the buildings at the front on each side so the property is totally enclosed by <br />fences, seconded by R. Chairrian Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. Stoyanov, representing the builder, who explained that they <br />were going to expand the Metro Lexus dealership by consolidating two additional <br />parcels to the east of the existing parcel in order to have a new facility for <br />the sale of the Infinity automobile. Part of their proposal is the selective <br />display of automobiles 20 feet ba.ck.from the right of way because it is difficult <br />to maxket automobiles if they are not visible to the public. The automobiles will <br />be displayed on concrete triangles behind the 20 foot landscape area, and the <br />pods are triangular to confo:rm to the shape of the building. Building <br />Commissioner Conway asked if there would only be one car on ea.ch triangle, <br />instead of 2 or 3 cars squeezed onto a pad. It was clarified that when the Metro <br />Lexus facility was being built, pods had been suggested, but they did not return <br />with a request for them. Mr. Gomersall pointed out that there were at least 200 <br />cars on the site. One of the neighbors had stated that originally only 35 cars <br />were to be on the site. Mr. Stoyanov maintained that this had never been <br />discussed at the original meeting. At this point one of the neighbors, Mr. <br />Stephin who lives behind Lexus, was sworn in. He stated that originally this was <br />not to be a terminal where all cars were tmloaded and distributed to tlie other <br />dealers. He still maintained there was to be no more than 35 cars. N3r. Conway <br />disagreed, stating that the original plans had the same parking plan that is <br />shown now. He agreed that there were a lot of cars, but this is not a terminal <br />for other dealers. Mr. Stoyanov stated that the economy has affected their sales <br />and there are more cars than the:re were or.iginally. Mr. Gomersall stated that <br />there are new cars parked in front now. Mr. Conway advised that the front parking <br />area will have to be left for customer parking, especially if a variance is <br />granted and the Building Department will check this. He further advised that when <br />cars are stored, they can be stacked and do not necessarily have to be in parking <br />spots. He also explained that Planning Commission requested that the fence that <br />was to be moved would be instal]_ed i.n the rear to protect the neighbors. The <br />commission also discussed a mound. Mr. Stoyanov explained that, in respect to the <br />lights that the neighbors complained about, the timer was not working and all the <br />lights were left on all night. 'Che timer had been designed so that only a few <br />night lights were to remain on all night. They are also going to adjust some of <br />the other lights so they do not shine an tlie neighbors property. It was clarified <br />that there would be 20 foot of landseaping up to the tip of the diamond shaped <br />pad. The members had no objectioris and Law Director Gareau stated that the board <br />has frequently asked for this type arrangement. In reference to the side yard <br />variance, Mr. Stoyanov explained that there is a storm retention system next to <br />4
